Member Scherer introduced and read the following written reso-
lution and MOVED its adoption:
RESOLUTION
WAIVING PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES 1129.031,
SUBD. 3, ORDERING CONSTRUCTION, APPROVING PLANS AND SPECIFICATIONS
AND AUTHORIZING CONTRACT CHANGES PURSUANT TO MINNESOTA STATUTES

BE IT RESOLVED, by the Village Council of the Village of Golden
Valley, Minnesota as follows:
1. Whereas, all the owners of real property affected by public
improvement 611-WML-11, and abutting on any street named as the location
of said improvement have petitioned the Council to construct the im-
provement and to assess the entire cost against their property, it is
hereby found and determined that the public hearing is not necessary
pursuant to Minnesota Statutes 1129.031, Subd. 3.
2. Being fully advised of the pertinent facts, this Council does
hereby determine to proceed with the construction of the proposed public
improvement for said village in accordance with the description of said
improvement contained in the petition and waiver of right to public
hearing.
3. It is hereby found and determined that said public improvement
is feasible (the Council reserves the right to consolidate said improve-
ment with such public improvements as it may seem advisable to do so).
4. The cost of said improvement shall be paid out of special
assessments to be levied as suthorized by law and the Village Engineer
is hereby designated as Engineer for the construction of said pro-
posed public improvement and is hereby authorized, ordered, and instruct-
ed to prepare final plans and specifications for said improvement and
submit the same to the Village Council for approval at the earliest
possible date.
5. That the final plans and specifications for 611-WML-11, are
hereby approved.
6. Whereas, a certain contract entered into April 16, 1963, with
Nodland Construction Company for public improvements Water Main (63 -WMT)
and awarded on a unit price basis with a total contract price of $621,670.00
and, whereas the above improvement on the same unit price basis, including
the cost of other improvements previously added thereto, does not exceed
25 per cent of the original contract price, the Mayor and the Village
Clerk are hereby authorized to change the contract awarded for Water
Main (63 WMT) of April 16, 1963, so as to include the additional units
of work at the same unit price providing for the construction of public
improvement number 611 WML-11, when the contractor shall have furnished
a contractor's bond in the amount of the additional work conditioned
as required by law.

The motion for the adoption of the foregoing resolution was duly
seconded by Member Schaphorst and upon vote being taken thereon, the
following voted in favor thereof: Flannagan, Nadasdy, Schaphorst,
Scherer, and Teresi; and the following voted against the same: None,
whereupon said resolution was declared duly passed and adopted, signed
by the Mayor and his signature attested by the Village Clerk.
