Member Scherer introduced and read the following resolution
and MOVED its adoption:
RESOLUTION ORDERING CONDEMNATION
(63 -LF -1)
WHEREAS, it is necessary, advisable, and in the public interest
that the Village of Golden Valley acquire (an) easement (s) over,
across and in certain lands for perpetual utility and drainage pur-
poses, and temporary construction easements, and
WHEREAS, in order to accomplish this, it is necessary to acquire
(an) easement (s) over, across and in the following -described lands,
namely:
W. J. Thomas
A Perpetual Utility and Drainage Easement in, on over and across the
North Ten (10) feet of the North 99.7 feet of the South 299.25 feet
of that part of the North one-half (*) of the Northeast one-quarter
(NAO of the Northeast one-quarter (NE-) of Section 29, Township 118,
Range 21, lying East of the West 657.12 feet thereof.
And also a Temporary Construction Easement over and across the North
Thirty (30) feet of the North 99.7 feet of the South 299.25 feet of
that part of the North one-half (*) of the Northeast one-quarter
(NF;4) of the Northeast one-quarter (NE4) of Section 29, Township 118,
Range 21, lying East of the West 657.12 feet thereof, said Temporary
Easement to expire on December 31, 1964.
And also a Perpetual Easement in, on, over and across all that part
of the North 50.3 feet of the South 349.55 feet of that part of the
North one-half (NI) of the Northeast one-quarter (NE14) of the North-
East one-quarter (NES) of Section 29, Township 118, Range 21, lying
East of the West 957.12 feet thereof, said easement being adjacent
to and lying Ten (10) feet on either side of the following described
centerline: Commencing at the Northeast corner of the above described
tract of land; thence West along the North line thereof 262 feet, more
or less; thence Southwesterly to a point in the West line of the above
described tract of land distant 22.0 feet, more or less, North of the
Southwest corner thereof and there terminating.
And also a Temporary Construction Easement over and across all that
part of the North 50.3 feet of the South 349.55 feet of that part of
the North one-half (NI!5) of the Northeast one-quarter (V4) of the
Northeast one-quarter (NE4) of Section 29, Township 118, Range 21,
lying East of the West 957.12 feet thereof, said Temporary Easement
being adjacent to and lying Ten (10) feet on either side of the
following described centerline: Commencing at the Northeast corner
of the above described tract of land; thence West along the North
line thereof 262 feet, more or less; thence Southwesterly to a point
in the West line of the above described tract of land distant 22.0 feet,
more or less, North of the Southwest corner thereof and there terminating
said Temporary Easement to expire on December 31, 1964.

29, Township 118, Range 21, lying East of the West 1037.12 feet there-
of; also that part of the North one-half (N�) of the Northeast one-
quarter (NE4) of the Northeast one-quarter (NE4) of Section 29, Town-
ship 118, Range 21, lying East of the West 957.12 feet thereof; North
of the South 349.55 feet thereof and South of the North 220.57 feet
thereof, except roads.
And also a Temporary Construction Easement over and across the South
Thirty (30) feet of the North 220.57 feet of that part of the North-
east one-quarter (NE4) of the Northeast one-quarter (NE4) of Section
29, Township 118, Range 21, lying East of the West 1037.12 feet there-

thereof, except roads, said temporary easement to expire on December

South Ten (10) feet of the East 120.0 feet of the West 777.12 feet of
that part of the North one-half (*) of the Northeast one-quarter (NE4)
of the Northeast, one-quarter (NE4) of Section 29, Township 118, Range
21, lying North of the South 299.25 feet thereof, except road.
And also a Temporary Construction Easement over and across the South
thirty (30) feet of the East 120.0 feet of the West 777.12 ,feet of
that part of the North one-half (1h) of the Northeast one-quarter
(NE 4) of the Northeast one-quarter (04) of Section 29, Township 118,
Range 21, lying North of the South 299.25 feet thereof., except road,
said Temporary Easement to expire on December 31, 1964.

A Perpetual Utility and Drainage Easement, Twenty (20) feet in width,
in, on, over and across the East 90.0 feet of the West 957.12 feet of
that part of the North one-half (Wg) of the Northeast one-quarter (NE4)
of the Northeast one-quarter (NE4) of Section 29, Township 113, Range
21, lying North of the South 299.25 feet thereof; said perpetual ease-
ment lying Ten (10) feet on either side of the following described
centerline: Commencing at the Southwest corner of the above described
tract of land, thence East along the South line thereof, a distance of
31.0 feet; thence Northeasterly to a -point in the East line of the
above described tract of land, distant 22 feet, more or less, North of
the Southeast corner thereof, as measured along the East line thereof,
and there terminating.

Forty (40) feet of the East 90.0 feet of the West 957.12 feet of that
part of the North one-half (*) of the Northeast one-quarter (NE4) of
the Northeast one-quarter (NV -4) of Section 29, Township 118, Range 21,
lying North of the South 299.25 feet thereof, said Temporary Easement
to expire on December 31, 1961.

A Perpetual Utility and Drainage Easement in, on, over and across the
South Ten(10) feet of the East 90.0 feet of the West 867.12 feet of
that part of the North one-half (*) of the Northeast one-quarter
(NE 4) of the Northeast one-quarter (NES) of Section 29, Township 118,
Range 21, lying North of the South 299.25 feet thereof.
And also a Temporary Construction Easement over and across the South
Thirty (30) feet of the East 90.0 feet of the West 867.12 feet of
that part of the North one-half (*) of the Northeast one-quarter
(NEh) of the Northeast one-quarter (N04-) of Section 29, Township 118,
Range 21, lying North of the South 299.25 feet thereof, said Temporary
Easement to expire on December 31, 1964.
WHEREAS, it has become and is necessary to procure said easement(s)
thereto by right of eminent domain, and
WHEREAS, the Village of Golden Valley believes that the most feas-
ible location for such perpetual utility and drainage easements and
construction easements is on the lands described above; Now, therefore,
BE IT RESOLVED that the Village of Golden Valley proceed to pro-
cure said easement(s) and title thereto, under its right of eminent
domain, and that the Village Attorney be instructed and directed to
file the necessary petitions therefor, and to prosecute such action
to a successful conclusion or until it is abandoned, dismissed or
terminated by the Village or by the Court; and that the Village Attor-
ney, the Mayor, and the Village Clerk do all things necessary to be
done in the commencement, prosecution, and successful termination of
such action.

The motion for the adoption of the foregoing resolution was duly
seconded by Member Schaphorst and, upon vote being taken thereon, the
following voted in favor thereof: Flannagan, Nadasdy, Schaphorst,
Scherer, and Teresi; and the following voted against the same: None,
whereupon said resolution was declared duly passed and adopted, signed
by the Mayor, and his signature attested by the Clerk.
