#341 11-05-63 Order Condemndation (63-LF-1)t November 5, 1963 Resolution No. 311 Member Teresi introduced and read the following resolution and MOVED its adoption: RESOLUTION ORDERING CONDEMNATION (63 -LF -1) WHEREAS, it is necessary, advisable, and in the public interest quire (an) easement (s) over, that the Village of Golden Valley acquire utility and drainage pur- across and in certain lands for perp poses, and temporary construction easements, and WHEREAS, in order to accomplish this, it is necessary to acquire (an) easement (s) over, across and in the following -described lands, namely: Parcel 1 A Perpetual Utility and Drainage Easement in, on, over and across the South ofn(10) feet of the East 120.0 feet theat part of the North one-fhalf of West 777.12 feet o NF Northeast one-quarter of the Northeastone-quarter e-qua21, iterN*, ( of 4, NES) of Section 29, Township 118, Range the South 299.25 feet thereof, except road. And also a Temporary Construction Easement over and across the South Thirty (30) feet of the East 120.0 feet of the West 777.12 feet of that part of the North one-half of the Northeast one-quarter of the Northeast one-quarterN0'44,North of Nom) of Section 29, Township 118, Range 21, lying the South 299.25 feet thereof, except road, said temporary easement to expire on December 21, 1964. And also a Temporary Construction Easement over and across the South Thirty (30) feet of the East 90.0 feet of the West 957.12 feet of that part of the North one-half of the Northeast one- quarter of the Northeast one-quarter (*, NE4, N194) of Section 29, Township 118, Range 21, lying North of the South 299.25 feet thereof. Parcel 4 A Perpetual Utility and Drainage Easement, Ten (10) feet in width, in, on, over and across the North Ten (10) feet of the West 300.0 feet of the North 99.7 feet of the South 299.25 feet of that part of the North one-half of the Northeast one- quarter of the Northeast one-quarter (I , NF%j NE4) of Section 29, Township 118, Range 21, lying East of the West 657.12 feet thereof. And also a temporary Construction Easement over and across the North Thirty (30) feet of the West 300.0 feet of the North 99.7 feet of the South 299.25 feet of that part of the North one- half of the Northeast one-quarter of the Northeast one-quarter (NFA, NE14, NE 4) of Section 29, Township 118, Range 21, lying East of the West 657.12 feet thereof, said Temporary Easement to expire on December 31, 1964. And also a perpetual Drainage and Utility Easement, Twenty (20) feet in width, and centered on the following described line: Commencing at a point lying 957.12 feet East and 309.25 feet North of the Southwest Corner of the North one-half of the Northeast one-quarter of the Northeast one-quarter (*, NE4) NAO of Section 29, Township 118, Range 21; thence Southerly, parallel with the East line of said Section 29, 109.70 feet and there terminating. And also a Temporary Construction Easement, Forty (40) feet in width, and centered on the following described line: Commencing at a point lying 957.12 feet East and 309.25 feet North of the Southwest Corner of the North one-half of the Northeast one-quarter of the Northeast one-quarter (*-!*, NE14, NIM of said Section 29, Township 118, Range 21; thence Southerly, parallel with the East line of said Section 29, 109.70 feet and there terminating, said Temporary Easement to expire on December 31, 1964. r l 02 Resolution No. 341 November 5, 1963 And also a Perpetual Utility and Drainage Easement Fifteen (15) feet in width in, on, over and across the South Fifteen (15) feet of the North 150 feet of the South 349.55 feet of that part of the North one-half of the Northeast one-quarter of the Northeast one-quarter (Ni-gs, NE14, NE4) of Section 29, Township 118, Range 21, lying East of the West 967.12 feet thereof, except road. And also a Temporary Construction Easement, Forty (40) feet in width over and across the South Forty (40) feet of the North 150 feet of the South 349.55 feet of that part of the North one-half of the Northeast one-quarter of the Northeast one- quarter (101, NE4, NE4) of Section 29, Township 118, Range 21, lying East of the West 977.12 feet thereof, except road, said Temporary Easement to expire on December 31, 1964. Parcel 5 A Temporary Construction Easement, Ten (10) feet in width lying over and across the North Ten (10) feet of that part of the South 199.55 feet of the North one-half of the Northeast one-quarter of the Northeast one-quarter (*, RR•�4-, NE4) of Section 29, Township 118, Range 21, lying East of the West 937.12 feet North of the South 99.8 feet, thereof, except road. WHEREAS, it has become and is necessary to procure said easement (s) thereto by right of eminent domain, and WHEREAS, the Village of Golden Valley believes that the most feas- ible location for such perpetual utility and drainage easements and construction easements is on the lands described above; Now, therefore, BE IT RESOLVED that the Village of Golden Valley proceed to pro- cure said easement (s) and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or ter- minated by the Village or by the Court; and that the Village Attorney, the Mayor, and the Village Clerk do all things necessary to be done in the commencement, prosecution, and successful termination of such action.
