Member Teresi introduced the following resolution and MOVED its adoption:
RESOLUTION AUTHORIZING AND DIRECTING APPEAL
TO DISTRICT COURT IN THE MATTER OF GENERAL HOSPITAL
BUDGET AND TAX LEVY
FOR 196►
WHEREAS, pursuant to Minnesota Laws of 1963, Chapter 738, the village
of Golden Valley and other towns and municipalities in Hennepin County re-
quested the Board of Commissioners of Hennepin County to conduct a hearing
to review the determinations previously made by it in the 1964 budget for
General Hospital, and
WHEREAS, such hearing was duly held on November 18, 1963, and
WHEREAS, on November 26, 1963 the Board of Commissioners of Hennepin
County adopted a resolution taking final action on the 1964 budget for
General Hospital, thereby making a determination of the issues raised at
such hearing, and
WHEREAS, it appears necessary and desirable for the Village of Golden
Valley to appeal to the district court from such final resolution,
NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Golden Valley as follows:
1. It is hereby determined to appeal from the final resolution of the
Board of Commissioners of Hennepin County, passed November 26, 1963, relating
to the budget of General Hospital.
2. Such appeal shall be made pursuant to Minnesota Laws of 1963, Chapter
738, on the grounds that the budget approved in such final resolution was not
prepared,items of expense were not allocated, and tax levies to be made pur-
suant thereto were not determined, in accordance with applicable law.
3. Clayton L. LeFevere is hereby designated to act as attorney for the
village in the presentation of such appeal.

The motion for the adoption of the foregoing resolution was duly seconded
by Member Flannagan and, upon vote being taken thereon, the following voted
in favor thereof: Flannagan, Nadasdy, Scherer, and Teresi; and the following
voted against the same: None, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor, and his signature attested by the
Clerk.
