Member Teresi introduced and read the following resolution and MOVED
its adoption:
RESOLUTION ORDERING CONDEMNATION
(64 -WMT and 64-WML)
WHEREAS, it is necessary, advisable, and in the public interest that
the Village of Golden Valley acquire (an) easement(s) over, across and in
certain.lands for street, road, and utility purposes, and
WHEREAS, in order to accomplish this it is necessary to acquire (an)
easement(s) over, across and in the following -described lands, namely:
A perpetual easement 60 feet in width for street and utility
purposes over and across the North 1/2 of the Southwest 1/4 of the
Southwest 1/4 of Section 31, Township 118 North, Range 21 West,
lying West of the East six acres thereof, Village of Golden Valley,
Minnesota, according to the government survey thereof, the Easterly
and Northeasterly Lines of said easement being described as beg-
inning at the intersection of the South line of the Southeast 1/4
of the Southwest 1/4 of Section 31, Township 118, Range 21, Hennepin
County, Minnesota, with a line 30 feet East of, measured at right
angles to, and parallel with the West line of said Southeast 1/4
of the Southwest 1/4; thence North parallel with said West line to
the beginning of a curve that is concave to the Southwest; the
Last described line is tangent to said curve and the following
described line is also tangent to said curve, and is described as
beginning at a point in the North line of the Southwest 1/4 of
the Southwest 1/4 of said Section 31, which point is 719.8 feet
East, measured along said North line, from the Northwest corner
of said Northwest 1/4 of the Southwest 1/4, and said point being
hereinafter known as "Point All, and thence running Southeasterly
and passing through the Southwest corner of the East two acres
of the North 1/2 of said Southwest 1/4, and said curve has tan-
gents 200 feet in length; thence Northwesterly along said curve
to its point of tangency; thence Northwesterly, tangent to said
curve, passing through the aforementioned "Point All.

A perpetual easement 60 feet in width for street and utility pur-
poses over and across the West four acres of the East six acres
of the North 1/2 of the Southwest 1/4 of the Southwest 1/4 of
Section 31, Township 118, Range 21, according to the U. S. Govern-
ment survey thereof, the Easterly and Northeasterly lines of said
easement being described as beginning at the intersection of the
South line of the Southeast 1/4 of the Southwest 1/4 of Section
31, Township 118, Range 21, Hennepin County, Minnesota, with a
line 30 feet East of, Measured at right angles to, and parallel
with the West line of said Southeast 1/4 of the Southwest 1/4;
thence North parallel with said West line to the beginning of a
curve that is concave to the Southwest; the Last described line

is tangent to said curve and the following described line is also
tangent to said curve, and is described as beginning at a point
in the North line of the Southwest 1/4 of the Southwest 1/4 of
said Section 31, which point is 749.8 feet East, measured along
said North line, from the Northwest corner of said Southwest 1/4
of the Southwest 1/4 and said point being hereinafter known as
"Point A", thence running Southeasterly and passing through the
Southwest corner of the East two acres of the North 1/2 of said
Southwest 1/4 of the Southwest 1/4, and said curve has tangents
200 feet in Length; thence Northwesterly along said curve to its
point of tangency; thence Northwesterly, tangent to said curve,
passing through the aforementioned "Point A".

A perpetual easement 60 feet in width for street and utility
purposes over and across that part of the South 1/2 of the
Southwest 1/4 of the Southwest 1/4 of Section 31, Township 118,
Range 21, described as follows: Beginning at the Southwest cor-
ner of said Southwest 1/4 of the Southwest 1/4; thence North
along the West line of said Southwest 1/4 of the Southwest 1/4
248.75 feet to the center line of Bassett's Creek; thence at
right angles East along said center line 30.35 feet; thence
Northeasterly along said center line 842.42 feet to a point in
the North line of said South 1/2 of the Southwest 1/4 of the
Southwest 1/4 distant 502.3 feet West of the Northeast corner
thereof; thence East along said North line 502.3 feet to the
Northeast corner of said tract; thence South along the East
line of said Southwest 1/4 of the Southwest 1/4 to the South-
east corner thereof; thence West along the South line of said
Southwest 1/4 of the Southwest 1/4 to the point of beginning,
the Easterly and Northeasterly lines of said easement being
described as beginning at the intersection of the South line
of the Southeast 1/4 of the Southwest 1/4 of Section 31, Town-
ship 118, Range 21, Hennepin County, Minnesota, with a line
30 feet East of, measured at right angles to, and parallel
with the West line of said Southeast 1/4 of the Southwest 1/4;
thence North parallel with said West line to the beginning
of a curve that is concave to the Southwest; the last described
line is tangent to said curve and the following described line
is also tangent to said curve, and is described as beginning
at a point in the North line of the Southwest 1/4 of the South-
west 1/4 of said Section 31, which point is 749.8 feet East,
measured along said North line, from the Northwest corner of
said Southwest 1/4 of the Southwest 1/4, and said point being
hereinafter known as "Point All, and thence running Southeasterly
and passing through the Southwest corner of the East two acres
of the North 1/2 of said Southwest 1/4 of the Southwest 1/4,
and said curve has tangents 200 feet in length; thence North-
westerly along said curve to its point of tangency; thence
Northwesterly, tangent to said curve, passing through the afore-
mentioned "Point All.

inning at the intersection of the South line of the Southeast
1/4 of the Southwest 1/4 of Section 31, Township 118, Range
21, Hennepin County, Minnesota, with a line 30 feet East of,
measured at right angles to, and parallel with the West line
of said Southeast 1/4 of the Southwest 1/4; thence North
parallel with said West line to the Beginning of a curve that
is concave to the Southwest; the last described line is tangent
to said curve and the following described line is also tangent
to said curve, and is described as beginning at a point in the
North line of the Southwest 1/4 of the Southwest 1/4 of said
Section 31, which point is 7.9.8 feet East, measured along said
North line, from the Northwest corner of said Southwest 1/4 of
the Southwest 1/4, and said point being hereinafter known as
"Point All, and thence running Southeasterly and passing through
the Southwest corner of the East two acres of the North 1/2 of
said Southwest 1/4 of the Southwest 1/4, and said curve has
tangents 200 feet in length; thence Norhtwesterly along said
curve to its point of tangency; thence Northwesterly, tangent
to said curve, passing through the aforementioned "Point All.
WHEREAS, it has become and is necessary to procure said easement(s)
and title thereto by right of eminent domain, and
WHEREAS, the Village of Golden Valley believes that the most feasible
location for such street and parts thereof is on the lands described above,
Now, Therefore,
BE IT RESOLVED that the Village of Golden Valley proceed to procure
said easement(s) and title thereto, under its right of eminent domain, and
that the Village Attorney be instructed and directed to file the necessary
petitions therefor, and to prosecute such action to a successful conslusion
or until it is abandoned, dismissed or terminated by the Village or by the
Court; and that the Village Attorney, the Mayor, and the Village Clerk, do
all things necessary to be done in the commencement, prosecution, and suc-
cessful termination of such action.

The motion for the adoption of the foregoing resolution was duly
seconded by Member Flannagan and, upon vote being taken thereon, the
following voted in favor thereof: Flannagan, Nadasdy, Schaphorst,
and Teresi; and the following voted against the same: None, whereupon
said resolution was declared duly passed and adopted, signed by the
Mayor, and his signature attested by the Clerk.
