#416 07-21-64 Waive Public Hearing Public Improvement 64-WML-78Resolution No. 416 July 21, 1961 Member Flannagan then introduced the following resolution and MOVED its adoption: RESOLUTION WAIVING THE PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES 129.031, SUBD. 3 AND ORDERING CONSTRUCTION OF A -CERTAIN PROPOSED PUBLIC IMPROVEMENT (64-WML-78 ) BE IT RESOLVED, by the Village Council of the Village of Golden Valley, Minnesota as follows: I. WHEREAS, all the owners of real property affected by public im- provement 64-WML-78 and abutting upon any street named as the location of said improvement have petitioned the Council to construct the im- provement and to assess the entire cost against their property, it is hereby found and determined that public hearing is not necessary pur- suant to Minnesota Statutes 129.031, Subd. 3. II. Being fully advised of the pertinent facts, this Council does here- by determine to proceed with the construction of the proposed public im- provement for said Village in accordance with the description of said improvement contained in the petitions and waivers of right to public hearing. It is hereby found and determined that said public improvement is feasible (the Council reserves the right to consolidate said improvements with such other improvements as it may deem advisable to do). IV. The cost of said improvement shall be paid out of special assessments to be levied as authorized by law. V. The Village Engineer is hereby designated as engineer for the con- struction of said proposed public improvement and is hereby authorized, ordered and instructed to prepare final plans and specifications for said improvement and submit the same to the Village Council for approval at the earliest possible date. i� 1 Resolution No. x.16 Mayor Attest: Village Clerk July 21, 1961 The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst and upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Schaphorst, and Teresi and the following voted against the same: None, whereupon the said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. 1 1
