#101 08-24-65 Supply Water to Proprties on Border StreetsResolution No. 101 August 24, 1965 Member Schaphorst introduced the following resolution and moved its adoption: RESOLUTION RELATING TO SUPPLYING WATER TO PROPERTIES ON BORDER STREETS 1r1HEREAS, the commission is frequently presented with requests that member communities be authorized to supply water service to properties which are outside the corporate limits of any member community, but adjacent to boundary streets of member communities, and AREAS, Section 3.12 of the joint agreement requires that the commission give its approval before such requests can be honored, and 11HEREAS, the commission desires to simplify procedure for giving its consent, so as to give its standing consent to certain routine applications of that nature, NOW, THEREFORE, BE IT RESOLVED by the Golden Valley, Crystal and New Hope Joint Water Commission as follows: 1. This commission herewith gives its standing consent to the member communities of Golden Valley, Crystal and New Hope, to extend water service to properties that have premises abutting upon a public street or highway which coincides with the municipal boundary of any part, providing that the following conditions exist: (a) The premises to which such service is extended shall be either a single family residence, a church or a school. (b) The building or structure to be provided with water service shall be within 100 feet of the nearest edge of the right- of-way of the street from which water service is to be extended. (c) The building or structure to be provided with water service shall be so located that it is unlikely that any new lots will be created on land lying between such building or structure and the boundary street from which water service is to be extended. 2. Any other application not conforming to all of the criteria here- inbefore set forth shall be submitted to the commission for prior approval before water service is extended. Mayor Attest: Village Clerk Resolution No. 101 August 24, 1965 The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan, and upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk.
