Member Flannagan introduced the following resolution and moved its
adoption:
RESOLUTION REQUESTING COMMISSIONER OF TAXATION
TO REJECT RECOMMENDATION MADE BY STAFF MEMBERS
ON CERTAIN PROPERTY OF MINNEAPOLIS GAS COMPANY
IHEREAS, the Village Council of the Village of Golden Valley did on
September 8, 1965, at the Special Council Meeting, consider a letter
presented to them by Robert Burns, Village Assessor, said letter relating
to a certain building constructed on Minneapolis Gas Company property in
the Village of Golden Valley, legally described as:
That part of N.W. 1} of NW 4 lying V1. of R.RAi
and sly of Co. Rd. No. 6 plat 8.533 parcel 3610
WHEREAS, said letter states the recommendation of Mr. James M. Hall,
property appraisal staff, and Mr. Terrance Manly, Utility Section, of the
Minnesota State Tax Department, in regard to the status of said building
after field investigation.
I'MREAS,the recommendation has ascertained this building to be a part
of the overall Utility operation, contrary to an earlier finding and
decision of the Commissioner of Taxation; (Hearing of November 13, 1963).
"v1HEREAS, the aforesaid recommendation is incompatable with'the Village
Councils previous findings, the Commissioner of Taxations earlier position
and decision, and the Councils' understanding of statements made by
representatives of the Minneapolis Gas Company at the time when the permit
was taken out for the "Office and Research" structure.
THEREFORE BE IT RESOLVED BY the Vill-age Council of the Village of
Golden Valley that said Council hereby requests the Commissioner of
Taxation to reject the recommendation made by staff members and to
reaffirm his previous decision, and in the absence of the Commissioner
of Taxation taking such action that this Village be afforded the oppor-
tunity for a hearing before the Commissioner of Taxation makes any
final decision herein, Pursuant to Minnesota Statutes, Section 270.19.

The motion for the adoption of the foregoing resolution was duly
seconded by member `I'eresi and, upon vote being taken thereon, the
following members voted in favor thereof: Flannagan, Nadasdy, and Teresi;
and the following voted against the same: None, whereupon said resolution
was declared duly passed and adopted, signed by the Mayor and his
signature attested by the Village Clerk.
