#103 09-08-65 Waive Hearing Improvement 65-WM-39Resolution No. 103 September 8, 1965
Member Teresi introduced the following resolution and moved its
adoption.
RESOLUTION
WAIVING THE PUBLIC HEARING PURSUANT TO
MINNESOTA STATUTES 429.031, SUBD. 3 AND
ORDERING CONSTRUCTION OF A CERTAIN PROPOSED PUBLIC IMPROVEMENT
(Proposed Water Main 65-101-39)
BE IT RESOLVED by the Village Council of the Village of Golden
Valley, Minnesota, as follows:
1. 1 EREAS, all the owners of real property affected by public
improvement 65 -;'JM 39 and abutting upon any street names as the location
of said improvement have petitioned the Council to construct the
improvement and to assess the entire cost against their property, it is
hereby found and determined that public hearing is not necessary pur-
suant to Minnesota Statutes 429.031, Subd. 3.
2. Being fully advised of the pertinent facts, this Council does
hereby determine to proceed -vr.th the construction of the proposed public
improvements for said Village in accordance with the description of said
improvements contained in the petition and waiver of right to public
hearing.
3. It is hereby found and determined that said public improvement
is feasible (the Council reserves the right to consolidate said improve-
ment with such other improvements as it may deem advisable to do).
4. The cost of said improvement shall be paid out of special
assessments to be levied as authorized by law.
5. The Village Engineer is hereby designated as engineer for the
construction of said proposed public improvement and is hereby authorized,
ordered and instructed to prepare final plans and specifications for said
improvement and submit the same to the Village Council for approval at the
earliest possible date.

The motion for the adoption of the foregoing resolution was duly
seconded by Member Flannagan, and upon vote being taken thereon the
following members voted in favor thereof: Flannagan, Nadasdy, and
Teresi; and the following voted against the same: None, whereupon
sfti.d resolution was declared duly passed and adopted, signed by the
Mayor and his signature attested by the Village Clerk.
