#181 06-07-66 Order Comdemnation277 Resolution No. 181 June 7, 1966 Member Teresi introduced the following resolution and MOVED its adoption: RESOLUTION (Ordering Condemnation) WHEREAS, it is necessary, advisable, and in the public interest that the Village of Golden Valley acquire (an) easement(s) over, across and in certain lands for perpetual utility and drainage purposes, and temporary construction easements, and WHEREAS, in order to accomplish this, it is necessary to acquire (an) easement(s) over, across and in the lands hereinbelow described, and WHEREAS, it has become and is necessary toprocure said easement(s) thereto by right of eminent domain, and WHEREAS, the Village of Golden Valley believes that the most feasible location for such perpetual utility and drainage easements and construction easements is on the lands described below; NOW, THEREFORE, BE IT RESOLVED, that, pursuant to Sections 412.11 and 41.2.221 of Minnesota Statutes, the Village Council of the Village of Golden Valley, Hennepin County, Minnesota does hereby determine that it is necessary, desirable and in the public interest to acquire the lands hereinafter described by gift, lease, purchase or condemnation under the right of eminent domain for the purpose of perpetual utility and drainage easements, and that such use for which said lands are to be acquired is a proper public purpose. Said lands are located in Hennepin County and are described as follows, to -wit: The North one-half (Ii�) of the North one-half (�) of the Southwest one-quarter (�4-) of the Northwest one-quarter (4) of Section 29, Township 118, Range 21, Hennepin County, Minnesota, together with the North fifty-nine (59) feet of Lot 1, Block 1, Tyree Addition, and all of Outlot 1 of said Tyree Addition, except the west one hundred (100) feet of the South seventy-eight (78) feet thereof, all lying in Section 29, Township 118, Range 21, Hennepin County, Minnesota. BE IT FURTHER RESOLVED, that said lands herein described may be acquired when the necessary funds are available. BE IT FURTHER RESOLVED, that the Village of Golden Valley proceed to procure said easement(s) and title thereto, under its right of eminent domain, and that, if necessary, the Village Attorney be instructed and directed to file Court petitions therefor, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the Village or by the Court; and that the.Village Attorney, the Mayor, 278 Resolution No. 181 June 7, 1966 and the Village Clerk do all things necessary to be done in the commence- ment, prosecution, and successful termination of such action. Adopted by the Village Council this 7th day of June, 1966. Mayor Attest: Village Clerk The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Stockman, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Clerk. i
