#239 10-04-66 Authorize Cancellation Levy Fire Station Bonds365 Resolution No. 239 October ),E, 1966 Member Flannagan introduced the following resolution and MOVED its adoption: PTS OLTUION .dAIVIi1G TIE PUBLIC REARI.vG PURSUANT TO YMINESOTA STATUTES 429.031, SURD. 3 AND ORDERING CONSTRUCTION OF CERTAITJ PROPOSED PUBLIC I11PROVE11ENTS (66 -LF -9,-20 & 21) BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota, as follows: 1. IvIIIEREAS, all% gab of real property affected by public improvements 66 -LF -9 /a °a ting upon any street named as the location of said improvements have petitioned the Council to construct the improvements and to assess the entire cost against their property, it hereby is found and determined that public hearing is not necessary pursuant to Minnesota Statutes 429,031, Subd. 3. 2. Being fully advised of the pertinent facts, this Council does hereby determine to proceed with the construction of the proposed public improvements for said Village in accordance with the description of said improvements contained in the petition and waiver of right to public hearing. 3. It is hereby found and determined that said public improvements are feasible (The Council reserves the right to consolidate said improvements with such other improvements as it may deem advisable to do). 4. The cost of said improvements shall be paid out of special assessments to be levied as authorized by law. 5. The Village Engineer is hereby designated as engineer for the construct- ion of said proposed public improvements and is hereby authorized, ordered and instructed to prepare final plans and specifications for said improvements and submit the same to the Village Council for approval at the earliest possible date. i"ayor Attest: Village Clerk 366 Resolution No. 239 October 4, 1966 The motion for the adoption of the foregoing resolution was duly seconded by Member Stockman, and upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Stockman, and Teresi; and the following voted against the same: TJone, whereupon said resolution was declared duly passed and adopted, signed by the I-ayor and his signature attested by the Village Clerk'. 1
