#345 09-05-67 Waive Hearing Watermains 67-WM-8A, 12126 Resolution No. 345 September 5, 1967 Member Teresi then introduced the following resolution and MOVED its adoption: RESOLUTION WAIVING THE PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES 429.031, SUBD. 3 AND ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS (Proposed Watermains - 67-WM-8A and 12) BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota, as follows: WHEREAS, all the owners of real property affected by public improve- ments 67 -WK -8A and 12 and abutting upon any street named .as the location of said improvements have petitioned the Council to construct the improvements and to assess the entire cost against their property, it is hereby found and determined that public hearing is not necessary pursuant to Minnesota Stat- utes 429.031, Subd. 3. 2. BFing fully advised of the pertinent facts, this Council does hereby determine to proceed with the construction of the proposed public improvements for said Village in accordance with the description of said improvements contained in the petition and waiver of right to public hear- ing. 3. It is hereby found and determined that said public improvements are feasible. (The Council reserves the right to consolidate aaid improve- ments with such other improvements as it may deem advisable to do.) 4. The cost of said improvements shall be paid out of special assessments to be levied as authorized by law. 5. The Village Engineer is hereby designated as engineer for the construction of said proposed public improvements and is hereby authorized, ordered and instructed to prepare final plans and specifications for said improvements and submit the same.to the Village Council for approval at the earliest possible date. Mayor Attest: Village Clerk The motion for the adoption of the foregoing resolution was duly seconded by Member Stockman, and upon vote being taken thereon, the following voted in favor thereof: Bies, Garis, Nadasdy, Stockman, and Teresi; and the following voted against the same: None, whereupon said resolution was de- clared duly passed and adopted, signed by the Mayor and his signature at- tested by the Village Clerk.
