#471 09-03-68 Waive Hearing 68-CG-6 thru 22, 68-BS-1 Thru 10Resolution No. 471 September 3, 1968 Member Carlson introduced the following resolution and MOVED its adoption: RESOLUTION WAIVING THE PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES 429.031, SUBD. 3 AND ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS (Proposed Concrete Curb and Gutter - 68 CG 6, 7, 22 Proposed Bituminous Surfacing - 68 BS 1, 9, 10) BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota, as follows: I. WHEREAS, all the owners of real property affected by public improve- ments 68 CG 6, 7, and 22 and 68 BS 1, 9, and 10 and abutting upon any street named as the location of said improvement have petitioned the Council to construct the improvements and to assess the entire cost against their property, it is hereby found and determined that public hearing is not necessary pursuant to Minnesota Statutes 429.031, SUBD. 3. II. Being fully advised of the pertinent facts, this Council does hereby determine to proceed with the construction of the proposed public improvement for said Village in accordance with the description of said improvement c6ntained in the petition and waiver of right to public hearing. III. It is hereby found and determined that said public improvement is feasible. (The Council reserves the right to consolidate said improve- ment with such other improvements as it may deem advisabel to do.) IV. The cost of said improvement shall be paid out of special assess- ments to be levied as authorized by law. V. The Village Engineer is hereby designated as engineer for the con- struction of said proposed public improvement and is hereby authorized, ordered and instructed to prepare final plans and specifications for said improvement and submit the same to the Village Council for approval at the earliest possible date. Resolution No. 471 1 Mayor Attest: Village Clerk The motion for the adoption of the foregoing by Member Stockman, and upon vote being take in favor thereof: Bies, Carlson, Garis, and voted against the same: None, whereupon said passed and adopted, signed by the Mayor and Village Clerk. 1 1 September 3, 1968 resolution was duly seconded n thereon the following voted Stockman; and the following resolution was declared duly his signature attested by the 6301
