#220 02-01-71 Acquire Interceptors Metro Sewer Board7 Resolution No. 220 February 1, 1971 Member Ulstad introduced the following resolution and MOVED its adoption: RESOLUTION AUTHORIZING THE AGREEMENT FOR ACQUISITION OF INTERCEPTORS BY METROPOLITAN SEWER BOARD BE IT RESOLVED by the Metropolitan Sewer Board as follows: 1. Resolution No. 70-123, adopted by the Board on September 2, 1970, is repealed. 2. Under Laws 1969, Chapter 449, Section 5, Subdivision 2, the Metropolitan Sewer Board may require any local government unit in the metropolitan area to transfer to it the ownership of any interceptors owned by the local government unit which will be needed to implement the Metropolitan Council's com- prehensive plan for the collection, treatment and disposal of sewage in the metropolitan area. The Board hereby deter- mines, subject to approval by the Metropolitan Council, that the sewer pipes and necessary appurtenances described in Exhibit A which is attached hereto and made a part hereof are interceptors as defined by Chapter 449, Section 2; that such interceptors are and will be needed to implement the Council's plan; and that the Board assumes ownership of such interceptors - and all contracts for their construction as of December 31, 1970, unless such ownership is acquired prior thereto. 3. The Metropolitan Sewer Board hereby determines that each of the local government units owning an interceptor (or a con- tract for construction of an interceptor) designated in Exhibit A. shall transfer to the Board on or before December 31, 1970, all of its right, title and interest in and to such interceptor or contract. The proper officers of such local government units shall execute and deliver to the Board as of December 31, 1970, all deeds, conveyances, assignments and other documents necessary to vest in the Board good and marketable title to all such interceptors and contracts. 4. The Chief Administrator and the Chairman are authorized and directed to enter into any and all agreements with such local government units necessary to carry into effect the terms of this resolution. 5. The Chief Administrator is authorized and directed to present a copy of this resolution to the Metropolitian Council for approval pursuant to Chapter 449, Section 5, Subdivision 2.
