Resolution No. 353 May 15, 1972
Member Ulstad introduced the following resolution and MOVED its adoption:
RESOLUTION WAIVING THE PUBLIC HEARING
PURSUANT TO MINNESOTA STATUTES 129.031, SUBD. 3
AND ORDERING CONSTRUCTION
OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS
(Proposed Watermains 72-WM-5)
BE IT RESOLVED by the Village Council of the Village of Golden Valley,
Minnesota, as follows:
I
WHEREAS, all the owners of real property affected by the above pro-
posed public improvements and abutting upon any street named as the
location of said improvement have petitioned the Council to construct
the improvements and to assess the entire cost against their property,
it is hereby found and determined that public hearing is not necessary
pursuant to Minnesota Statutes 1129.031, Subd. 3.
II
Being fully advised of the pertinent facts, this Council does hereby
determine to proceed with the construction of the proposed public improve-
ment for said Village in accordance with the description of said improve-
ment contained in the petition and waiver of right to public hearing.
III
It is hereby found and determined that said public improvement is
feasible. (The Council reserves the right to consolidate said improve-
ment with such other improvements as it may deem advisable to do.)
IV
The cost of said improvement shall be raid out of special assessments
to be levied as authorized by law.
V
The Village Engineer is hereby designated as engineer for the construct-
ion of said proposed public improvement and is hereby authorized, ordered
and instructed to prepare final plans and specifications for said improvement
and submit the same to the Village Council for approval at the earliest
possible date.

The motion for the adoption of the foregoing resolution was duly
seconded by Member Paulson, and upon vote being taken thereon, the
following members voted in favor thereof: Hoover, Paulson, Riggs,
Stockman, and Ulstad; and the following voted against the same:
None, whereupon said resolution was declared duly passed and adopted,
signed by the Mayor, and his signature attested by the Village Clerk.
