#587 11-05-73 Waive Penalties Certain Special Assessments*182 Resolution 587 November 5, 1973 Member Hoover introduced the following resolution and MOVED its adoption: RESOLUTION (Waiving Penalties and Interest on Certain Special Assessments) WHEREAS, Independent School District No. 281 has recently acquired Lot 14 of Keene, Higbee & Bitzer's Golden Valley Outlots by condemnation, said property to be used for the construction of the Olson Elementary School; and WHEREAS, the aforesaid Lot 14 of Keene, Higbee & Bitzer's Golden Valley Outlots was actually acquired by said School District, for the purposes hereof, at the time the report of the condemnation commissioner's was filed on February 19, 1970, but the proceedings were not completed until September of 1973 because of a legal dispute respecting the true ownership of the said Lot 14; and WHEREAS, during the above period of the condemnation proceedings there were no payments made on either the general property tax or any special assess- ments respecting said property; and WHEREAS, application has been made for the abatement of the general property taxes for 1971 and thereafter; and WHEREAS, Independent School District No. 281 is now requesting that the Village of Golden Valley waive penalty and interest on the installments of the unpaid special assessments which became payable after said school district acquired said property as aforesaid, the said school district recognizing its obligation to pay the principal balances due with respect to the said special assessments, NOW THEREFORE BE IT RESOLVED, by the Village Council for the Village of Golden Valley that all penalties and interest assessed by reason of the non-payment of the installments of special assessments on the aforesaid property for those installments falling due and payable in the years 1971, 1972 and 1973, be and they hereby are in all respects waived by the Village of Golden Valley in favor of Independent School District No. 281 as the legal owner of said property during all of the aforesaid taxing years. Mayor Attest: Village Clerk The motion for the adoption of the foregoing resolution was seconded by Member Moberg and upon vote being taken thereon the following voted in favor thereof: Bix, Hoover, Moberg, and Riggs; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk.
