#614 02-19-74 Rescind Resolution Approval Third Lane TH 12Resolution No. 614 February 19, 1974 Member Hoover introduced the following resolution and MOVED its adoption: RESOLUTION (Rescinding prior resolutions respecting plan approval for third lane on U. S. Highway No. 12 and providing conditions precedent for re -approval) WHEREAS, the Commissioner of Highways for the state of Minnesota has heretofore prepared preliminary plans for the improvement of that portion of Trunk Highway No. 12 from Trunk Highway 100 to the East corporate city limits of the City of Golden Valley, which preliminary plans were approved by this Council pursuant to its resolution No. 235 on May 3, 1971; and WHEREAS, the Commissioner of Highways has further prepared plans, special provisions and specifications for the aforesaid improvement which were also heretofore approved by this Council pursuant to its resolution No. 247, passed on June 7, 1971; and WHEREAS, it now appears that there have been a significant number of changes of circumstances in traffic conditions, development of adjacent and surrounding properties, alterations of roadway design and traffic controls, and significant vehicular traffic increase since the passage of the afore- said resolutions by this Council on May 3, 1971 and June 7, 1971; and WHEREAS, it further appears that since the dates of the passage of the aforesaid resolutions by this Council and to the date hereof a number of requests made by this Council of the Department of Highways and forming the basis of the earlier approvals have not been met nor provided for; NOW THEREFORE BE IT RESOLVED, by the City Council for the City of Golden Valley that it hereby rescinds and revokes in their entirety resolutions No. 235 and 247 passed by this Council on May 3, 1971 and June 7, 1971, respectively; and BE IT FURTHER RESOLVED, That any further consideration for re - approval of those certain plans for a third lane widening improvement of Trunk Highway No. 12, having been heretofore identified by the Department of Highway as plans No. SP. 2714-88 and SP. 2715-980 be expressly conditioned upon the following: 1. That contemporaneously with any such proposed improvement of Trunk Highway No. 12 as contemplated by the plans identified aforesaid provision be made for a safe and orderly cross flow of traffic between those areas in the City of Golden Valley known respectively as "North Tyrol" and "South Tyrol" by means of either: (a) an overpass, (b) an underpass, or (c) an appropriate semaphore signal or signals. 219 Resolution No. 614 February 19, 1974 2. That contemporaneously with any such proposed widening and as a part of the construction thereof there also be constructed a right turn lane leading off East bound Trunk Highway No. 12 and onto June Avenue on the Southerly side of said Trunk Highway No. 12 and that provision also be made for permitting right turns in an Easterly direction from and off said June Avenue lying South of Trunk Highway No. 12 and onto Trunk Highway No. 12. 3. That Natchez Avenue South of said Trunk Highway No. 12 be left for access from and onto said Highway No. 12. 4. That as an alternative to condition No. 1 above the "Department of Highways acquire access for and construct an extension of the service drive on the South side of Trunk Highway No. 12 from its present Easterly terminus at Tyrol Trail and thence in an Easterly direction paralleling said Trunk Highway No. 12 (running generally in front and to the North of the Prudential Insurance Company premises) to Glenwood Parkway on the East, so as to permit vehicular traffic from the "South Tyrol" area to move in both Easterly and Westerly directions along said service drive from the Glenwood Parkway interchange access point to the "South Tyrol" residential area. 5. That both the East and West bound lanes of Trunk Highway No. 12 be provided with bituminous resurfacing from Highway 100 on the West to the Golden Valley City limits on the East. Attest: Mayor Village- Clerk The motion for the adoption of the foregoing resolution was seconded by Member Anderson and upon vote being taken thereon the following voted in favor thereof: Anderson, Bix, Hoover and Riggs; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the MW or and his signature attested by the Village Clerk. 1
