Member Moberg introduced the following resolution and MOVED its adoption:
APPROVING AND AUTHORIZING EXECUTION OF AGREEMENT
WITH CHICAGO AND NORTHWESTERN TRANSPORTATION
COMPANY FOR STORM SEWER LICENSE
WHEREAS, the City of Golden Valley has applied to the Chicago and
Northwestern Transportation Company for permission to construct, maintain and
use a storm sewer under the railroad tracks belonging to said corportation and
located at a point on said tracks approximately south of the Southwesterly
corner of Sweeney Lake, and
WHEREAS, the Chicago and Northwestern Transportation Company has indicated
its willingness to give approval for the construction of a storm sewer under said
tracks at the aforesaid location upon condition that the City of Golden Valley
enter into a written license agreement containing certain terms and conditions
governing the construction, maintenance and use of said storm sewer;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Golden Valley:
That the Mayor of the City of Golden Valley, acting on its behalf, be
and he here is authorized to execute, on behalf of the City of Golden Valley,
that certain agreement dated October 7, 1974 relating to a license for the
City to construct, maintain and use a storm sewer upon and under the tracks
of the Chicago and Northwestern Transportation Company, said agreement to be
with said Chicago and Northwestern Transportation Company in the form as
submitted by said corporation to the City Engineer for the City of Golden
Valley under cover letter of said corporation dated September 30, 1974 and
incorporated herein by reference as fully as if made a part hereof.

The motion for the adoption of the foregoing resolution was seconded by
Member Hoover, and upon vote being taken thereon, the following voted in favor
thereof: Anderson, Bix, Moberg, Hoover, and Riggs; and the following voted
against the same: None, whereupon said resolution was declared duly passed
and adopted, signed by the Mayor, and his signature attested by the Clerk.
