#776 05-19-75 Authorize Attorney for Meyerdirk CaseResolution No, 776 May 19, 1975 Member Bix introduced the following resolution and MOVED its adoption: RESOLUTION (Authorizing City Attorney to Defend & Indemnify City Employees Re: Meyerdirk Case) WHEREAS, the City of Golden Valley, its Council and certain of its officers and employees have been named as defendents, in their official capacity and as individuals, in a lawsuit commenced by Kenneth C. Meyerdirk; and WHEREAS, it has been determined by the Council that the actions of each of the individual officers and employees of the City upon which the plaintiff's alleged cause of action is predicated occurred and were undertaken strictly within the scope of the performance of the respective duties of those officers and employees; and WHEREAS, under such conditions the City desires and, in accordance with the provisions of M.S. 466.07 is permitted, to defend, save harmless and indemnify such officers and employees from and against the claims, demands and liability asserted in said lawsuit; BE IT RESOLVED by the City Council of the City of Golden Valley that the City undertake to defend, save harmless, and indemnify those certain individual officers and employees named as defendants in the litigation commenced by Kenneth C. Meyerdirk from and against the claims and demands asserted therein, and that such defense, hold harmless and indemnity shall be directed to each said defendant's status as a defendant in his official capacity and as an individual, it having been determined that all actions taken by said defend— ants related to said lawsuit occurred within the performance of their several duties as officers and/or employees of the City of Golden Valley. (Mayor Attest: Acting C ty Clerk The motion for the adoption of the foregoing resolution was seconded by Member Anderson and upon vote being taken thereon the following voted in favor thereof: Anderson, Bix, Hoover, Riggs and Thorsen; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Acting City Clerk.
