#821 11-03-75 Amend Assessment Public Improvement"() Resolution No. 821 November 3, 1975 Member Bix introduced the following resolution and MOVED its adoption: RESOLUTION (Amending Assessment for Certain Public Improvement) WHEREAS, by Resolution No. 814 dated October 6, 1975, a certain public improvement, namely, bituminous surfacing on Sumter Avenue South between Erie Avenue and T.H. 12 (74—SI-9) was assessed at a rate of $5.83 per assessable foot, and WHEREAS, by the same Resolution, the residential portion of the bituminous surfacing on Laurel Avenue between Pennsylvania Avenue and Winnetka Ave. (74—SI-4) was assessed at $5.83 per assessable foot based upon the costs of 74—SI-9 above, and WHEREAS, review of the materials used and tests of the project indicate that an excess amount of material was applied on 74—SI-9 over and above that needed for a residential street and the correct assessment if this project had been constructed to residential street specifications would be $4.69 per assessable foot; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Golden Valley that the assessment rate for 74—SI-9 and the residential portion of 74—SI-4 be reduced to $4.69 per assessable foot and that a corrected assessment roll be pre— pared and forwarded to Hennepin County to be corrected future tax statements and, BE IT FURTHER RESOLVED that the excess costs a and,a�ove the corrected assessment above shall be transferred from the Pub i Work I provement Fund. Mayor Attest: City Clerk The motion for the adoption of the foregoing resolution was duly seconded by Member Swartz and upon vote being taken thereon, the following members voted in favor thereof: Anderson, Bix, Hoover, Swartz and Thorsen, and the following members voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the City Clerk. 1
