#003 01-17-77 Approve Waiver of Platting Golden Valley Lutheran CollegeResolution No. 3 January 17, 1977 Member Swartz introduced and read the following written resolution and MOVED its adoption: RESOLUTION A RESOLUTION APPROVING WAIVER OF PLATTING AND APPROVING A DIVISION OF UNPLATTED LAND FOR GOLDEN VALLEY LUTHERAN COLLEGE — LUTHERAN BIBLE INSTITUTE OF MINNEAPOLIS WHEREAS, the City Council of the City of Golden Valley has now considered the matter of the proposed waiver of platting and the division of the following described tract of land, located in the County of Hennepin, State of Minnesota, to -gait: All that part of the Northwest 1/4 of the Southwest 1/4 of Section 33, Township 118 North, Range 21 West of the 5th Principal Meridian, which lies South of 6th Avenue North, except Railroad right—of—way. WHEREAS, Lutheran Bible Institute of of Minneapolis ("LBI") owns the Premises described above; and WHEREAS, LBI organized and supports the Golden Valley Lutheran College (the "College") a Minnesota non—profit institution of higher education incorporated under the laws of Minnesota and having its campus and principal place of business at 6125 Olson Highway, on the premises legally described above, in Golden Valley, Minnesota; and WHEREAS, the College has applied to Minnesota Higher Education Facilities Authority,, and agency of the State of Minnesota (the "Authority") for financial assistance under Sections 136A.25 to 136A.41, Minnesota Statutes (the "Act") to construct, furnish and equip a new student residence for approximately 202 students (the 'Project"),; and WHEREAS, the Authority, as security for said financial assistance, is required to hold title to the following described portion of the above premises, to—wit: All that part of the Northwest Quarter of the Southwest Quarter of Section 33, Township 118 North, Range 21 West of the 5th Principal Meridian which lies South of 6th Avenue North, except Railroad right—of way and except that part of the East 301.87 feet of the West 546.57 feet of the above described property lying North of the South 555.37 feet thereof, Hennepin County, Minnesota; and WHEREAS, LBI shall retain title to the remaining portion legally described as follows, to—wit: Resolution No. 3 (cont.) January 17, 1977 That part of the East 301.87 feet of the West 546.57 feet of the Northwest Quarter of the Southwest Quarter of Section 33, Township 118 North, Range 21 West of the 5th Principal Meridian, lying North of the South 555.37 feet thereof and lying South of 6th Avenue North, Hennepin County, Minnesota; and WHEREAS, the College has petitioned the City Council to approve a division of the property and to waive the platting thereof in order to facilitate and accomplish such financial assistance from the Authority; and, WHEREAS, all persons present were given the opportunity to be heard, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GOLDEN VALLEY AS FOLLOWS: 1. Platting requirements of the City of Golden Valley are hereby waived with respect to the following described land situated in the County of Hennepin, State of Minnesota, to -wit; All that part of the Northwest Quarter of the Southwest Quarter of Section 33, Township 118 North, Ravage 21 West of the 5th Principal Meridian, which lies South of 6th Avenue North, except Railroad right-of-way. 2. The City Council does hereby approve the division of said land into two parcels as follows: PARCEL A All that part of the Northwest Quarter of the Southwest Quarter of Section 33, Township 118 North, Range 21 West of the 5th Principal Meridian which lies South of 6th Avenue North, except Railroad right -of- way and except that part of the East 301.87 feet of the West 546.57 feet of the above-described property lying North of the South 555.37 feet thereof, Hennepin County, Minnesota. PARCEL B That part of the East 301.87 feet of the West 546.57 feet of the Northwest Quarter of the Southwest Quarter of Section 33, Township 118 North, Range 21 West of the 5th Principal Meridian, lying North of the South 555.37 feet thereof and lying South of 6th Avenue North, Hennepin County, Minnesota. The proper officersof the City are her authorized and directed to do all things necessary and proper in he remises to effectuate and implement the within resolution." Robert R. Marske, City Clerk The motion for the adoption of the foregoing resolution was seconded by Member Johnson and upon vote being taken thereon, the following voted in favor thereof: Mayor°Hoover, Council members Anderson, Thorsen, Swartz and Johnson, and the following voted against the same: None, where— upon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk. 1 61 3. The division of said land, as set out above, is subject to the condition that upon repayment in Paragraph 2. in full by the College to the Authority of the financial assistance to be provided to the College by the Authority and upon re—conveyance by the Authority to the College of Parcel A above—described, said Parcel A and Parcel B shall again be constituted as and revert to a single parcel of record and described as set out in Paragraph 1. above. 4. The proper officersof the City are her authorized and directed to do all things necessary and proper in he remises to effectuate and implement the within resolution." Robert R.
