#078 08-15-77 Acquire Additional Easement Duluth StreetResolution No. 78 August 15, 1977 Member Swartz introduced and read the following written resolution and moved its adoption: RESOLUTION (Authorizing Acquisition by Condemnation or Purchase for Additional Easement Areas on Duluth Street) WHEREAS, it appears that it is necessary and desirable to acquire the real estate hereinafter described for additional utility easement area, and WHEREAS, the acquisition of said real estate through direct purchase or condemnation appears to be desirable and reasonable, NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Golden Valley that certain real estate described below be acquired by purchase or con- demnation and the Mayor, City Manager, City Clerk, and City Attorney are hereby authorized and directed to take all necessary steps and to execute the necessary documents in connection with the acuqisition of said real estate, to -wit: That part of the following described area in Blocks 10 and 11, Yarnall's Golden Valley Outlots: Commencing at a point in West line of Block 11 distance 125 feet North from its inter- section with the Northeasterly line of St. Croix Avenue thence Southeasterly deflecting 660 from South to East from said West line a distance of 115 feet to the actual point of beginning thence deflecting to the right 450 a distance of 99 feet thence Southwesterly to a point in the Northeasterly line of St. Croix Avenue a distance of 125 feet Southeasterly from its inter- section with the West line of Block 11 thence Southeasterly along said Northeasterly line of St. Croix Avenue to a point distance 466.8 feet Southeasterly from the Northwest corner of Block 10 thence deflecting left 890 to 20' 30'' a distance of 115.2 feet thence Northeasterly to a point in the East line of Block 10 a distance of 66.82 feet South from the Northeast corner thereof thence North to the Northeast corner of Block 11 thence West 200 feet thence South 163 feet thence West parallel with North line of Block 11 to a point distance 151 feet East from the West line thereof thence Southwesterly to beginning except road, Block 10 and 11. BE IT FURTHER RESOLVED, that the independent appraisal of the above- described real estate which shall be obtained as required by applicable Minnesota law be transmitted to the owner of said property and that an offer to purchase said property be made to the said owner for the amount of said appraisal, and BE IT FURTHER RESOLVED, that in the event the above described real estate cannot be acquired by negotiated purchase pursuant to said appraisal the appropriate officers of the City described above be authorized and directed to commence the appropriate condemnation proceedings, and Resolution No. 78 (con't) August 15, 1977 r 1 Robert R. BE IT FURTHER RESOLVED, that the acquisition of the above described land is necessary and desirable, and the purposes afor aid for which said lands are to be acquired are a proper and necessary publi p rpose. r 1 Robert R.
