Member Anderson introduced and read the following resolution and moved its adoption:
RESOLUTION
City Determination to Defend and Indemnify
Defendants in Troyer. vs. Hoover, et al.
WHEREAS, three members of the Unification Church commenced a legal
action against certain elected and appointed officials of the City of Golden
Valley during the summer of 1978 challenging the facial constitutionality of
the Peddlers and Solicitors Ordinance of the City and enforcement of the same;
and
WHEREAS, said legal action has been brought in the United States
District Court, District of Minnesota, Fourth Division, is entitled Ronald J.
Troyer and Wayne D. Culbertson vs. Robert R. Hoover, James Crawford, Mary
Anderson, Gloria Johnson, Ray Stockman and Rosemary Thorsen, File No. 4-78
Civil 237; and
WHEREAS, the thrust of said legal action now is to challenge the
recently amended version of the Peddlers and Solicitors Ordinance of the City
of Golden Valley and the defendants have been named solely in their official
capacities as elected and appointed officials;

The motion for the adoption of the foregoing resolution was seconded by Member
Mitchell and upon vote being taken thereon, the following voted in favor thereof:
Anderson, Johnson, Mitchell, Stockman and Thorsen and the following voted against
the same: none, whereupon said resolution was declared duly passed and adopted,
signed by the Mayor and her signature attested by the Clerk.
NOW THEREFORE, BE IT
RESOLVED by the City Council of
the City of
Golden Valley that the actions
by said legal action were taken
of all the defendants which are
i.n the performance of their duties
being challenged
as said
elected or appointed officials
of the city; and
BE IT FURTHER RESOLVED,
that the City shall continue
to defend and
indemnify the interests of all
defendants in said legal action
and bear the
costs thereof.
