#228 06-02-80 Accept Gift Schaper, W.H.Resolution #228 June 2, 1980 Member Stockman introduced and read the following resolution and moved its adoption: RESOLUTION Authorizing the Acceptance of a Donation of Real Estate as a Gift From W. H. Schaper and Frances Shaper, his Wife WHEREAS, W. H. Schaper and Frances Shaper, his wife, have offered to donate to the City of Golden Valley, certain real estate which has a market value of $250,000.00; and WHEREAS, the City Attorney has advised the City Council that Mr. and Mrs. Schaper have good title to the subject property, which is described as follows: That part of the Southeast Quarter of the Northwest Quarter, Section 19, Township 29, Range 24, described as commencing at the Southeast corner of said Southeast Quarter of the Northwest Quarter; thence West along the South line of said Southeast Quarter of the Northwest Quarter a distance of 310 feet; thence North, parallel with the East line of said Southeast Quarter of the Northwest Quarter, a distance of 455 feet to the actual point of beginning; thence West, parallel with said South line, a distance of 444.29 feet; thence North, parallel with said East line, a distance of 300 feet; thence West parallel with said South line, to the East line of the West 565.71 feet of said Southeast Quarter of the Northwest Quarter; thence North along the last described East line to the North line of the South 1055 feet of said Southeast Quarter of the Northwest Quarter; thence East along said North line to a line drawn North, parallel with said East line, from the actual point of beginning; thence South along the last described parallel line a distance of 600 feet to the actual point of be- ginning, except the Easterly 30 feet thereof. WHEREAS, the City Council has made by motion passed a regular Council meeting held on June 2, 1980, approved a letter agreement with Mr. and Mrs. Schaper dated May 6, 1980 respecting the proposed donation; and WHEREAS, Mr. and Mrs. Schaper, on May 27, 1980, delivered a deed to the City of Golden Valley conveying said property by gift to the City in accordance with the terms and conditions of said letter of understanding; NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Golden Valley, that the give of the above-described real estate is hereby accepted the City Clerk is authorized and directed to provide Mr. and Mrs. Schaper with a certified copy of this resolution, and the City Attorney is authorized and directed to file the deed thereto in the office of the Hennepin County Recorder in and for Hennepin County, Minnesota. RESOLVED FURTHER, that the above-described real estate shall be used for park, open space, and/or such other public purposes as its duly constituted City Council shall from time to time determine. Resolution #228 (continued) RESOLVED FURTHER, that the City of Golden Valley hereby acknowledges to W. H. Schaper and Frances Schaper its sincere appreciation for their gift of the above-described property and shall place a commemorative marker on the site, indicating it was donated by them for the improvement of the environment.
