Member Anderson introduced and read the following written resolution and moved
its adoption:
RESOLUTION
Authorizing the acquisition by purchase or trade of certain
property for a public building, parking and other public purposes
WHEREAS, it appears that it is necessary and desirable to acquire the
real estate hereinafter described to be used as public property in connection
with the City of Golden Valley Civic Center and other parking and public purposes
related to said Civic Center, and
WHEREAS, the acquisition of said real estate through a direct purchase or
trade from Hennepin County, Minnesota, through the acquisition of an adjoining
parcel of real estate now owned by the County of Hennepin, appears to be desirable
and reasonable, NOW THEREFORE
BE IT RESOLVED, by the City Council of the City of Golden Valley
that the lands hereinafter described may be acquired by purchase or trade from the
County of Hennepin, State of Minnesota, and the Mayor, City MAnager, City Clerk
and City Attorney are all hereby authorized and directed to take all necessary
steps and to execute all necessary documents in connection with the acquisition of
said real estate, to -wit:
A parcel of land lying and being in the County of Hennepin,
State of Minnesota, described as all that part of the following
tract lying northwesterly of the centerline of Bassett Creek;
Lots 32, 33, 34 and that part of Lot 31 lying north of the south
line of said Lot 34 extended easterly which lies west of a line,
parallel with the west line of the northwest 1/4 of Section 32,
Township 118, Range 21, which passes through a point in the
north line of said Lot 31 distant 470.10 feet east of the west
line of said northwest 1/4, as measured along the north lines
of said Lots 31 and 32 and its westerly extension, "Auditor's
Subdivision No. 360, Hennepin County, Minnesota".
BE IT FURTHER RESOLVED, that in consideration for the conveyance by
the County of Hennepin to the City of Golden Valley of the parcel of land above
described the City of Golden Valley shall transfer and convey to the County
of Hennepin all of that tract or parcel of land lying and being in the County
of Hennepin and State of Minnesota described as follows, to -wit:
The East 109.0 feet of the west 185.3 feet of the north 398.70
feet of Lot 31, Auditor's Subdivision No. 360, Hennepin County,
Minnesota, except that part thereof lying northwesterly of the center
line of Bassett Creek; subject to a drainage and utility easement
in, on, over and across the northerly 50.0 feet of all of that part of
the above-described tract lying southerly of Bassett Creek, said
easement described as lying northwesterly of a line 50.0 feet
southeasterly of the centerline of Bassett Creek, as measured per-
pendicular to and parallel with said centerline.
Also, A perpetual easement for driveway purposes over and
across Lot 31, Auditor's Subdivision No. 360, Hennepin County,
Minnesotan except the north 398.70 feet thereof.

BE IT FURTHER RESOLVED, that in consideration for the conveyance by
the County of Hennepin to the City of Golden Valley of the parcel of land above
described the City of Golden Valley shall transfer and convey to the County of
Hennepin all of that tract of parcel of land lying and being in the County of
Hennepin and State of Minnesota described as follows, to -wit:
The east 109.0 feet of the west 185.3 feet of the north 398.70 feet
of Lot 31, Auditor's Subdivision No. 360, Hennepin County,
Minnesota, except that part thereof lying northwesterly of the center
line of Bassett Creek; subject to a drainage and utility easment in,
on, over and across the northerly 50.0 feet of all of that part of
the above-described tract lying southerly of Bassett Creek, said
easement described as lying northwesterly of a line 50.0 feet south-
easterly of the centerline of Bassett Creek, as measured perpendicular
to and parallel with said centerline.
Also, A perpetual easement for driveway purposes over and across Lot
31, Auditor's Subdivision No. 360, Hennepin County, Minnesota,
except the north 398.70 feet thereof.
BE IT FURTHER RESOLVED, that the City Council of the City of Golden
Valley, upon and following due inquiry by it into all facts and circumstances made,
does hereby adjudge and determine that the portion of Lot 31, Auditor's Sub-
division No. 360, authorized to be conveyed to Hennepin County in accordance with
the foregoing paragraph is no longer needed for public purposes and the Mayor
and City Manager are therefore authorized and directed to prepare and execute a
deed for all of the property authorized to be conveyed to the County of
Hennepin in accordance with the foregoing paragraph, and
BE IT FURTHER RESOLVED, that the acquisition of the above-described
property to be acquired from the County of Hennepin is necessary and desirable,
that the purposes for which said property is to be acquired are proper and necessary
public purposes, and that the City Council has found and determined that the land
to be conveyed to the County of Hennepin in exchange for the property hereby
authorized to be acquired, all as more particularly described above, being no
longer needed for public purposes as recited above, is a fair and resonable
consideration to be given and transferred to the County of Hennepin for the
said exchange of properties as authorized hereby.

The motion for the adoption of the foregoing resolution was seconded by member
Johnson and upon vote being taken thereon the following voted in favor thereof:
Anderson, Stockman, Mitchell, Johnson, and Thorsen.

And the following voted against the same: none, whereupon said resolution was
declared duly passed and adopted, signed by the Mayor and her signature attested
by the Clerk.
