#093 10-20-81 Establish Issue on-Sale Liquor LicensesResolution #93 October 20, 1981 153 GZ Member Stockman introduced and read the following resolution and moved its adoption: RESOLUTION ESTABLISHING POLICY CRITERIA FOR THE ISSUANCE OF ON -SALE LIQUOR LICENSES WHEREAS, the City of Golden Valley has the power, pursuant to applicable state law, to regulate the issuance of on -sale intoxicating liquor licenses within its municipal limits; and WHEREAS, it is felt desirable to have guideline criteria which the City Council will follow in the issuance of such licenses; NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Golden Valley that guideline criteria are hereby established for the issuance of on -sale intoxicating liquor licenses within the City of Golden Valley as follows: 1. The subject premises for which such a license are sought shall have a minimum estimated market value of $850,000 as determined by the City Assessor for property tax purposes. 2. The establishment seeking such a license shall have a minimum of 150 seats in a restaurant area for sit down service (excluding seating available for food service in any waiting areas, bars or lounges). 3. A majority of the square footage in the service area (excluding food preparation areas, storage areas, employee areas, restrooms and the like) of any establishment seeking such a license must be devoted to restaurant use and the promotion, advertising and conduct of said business establishment must emphasize the restaurant function thereof. 4. At all times while this resolution remains in force and effect there shall be at least two on -sale intoxicating liquor licenses issued to or reserved for establishments located within the Valley Square area of the City of Golden Valley as defined in exhibit A attached to and made a part of this resolution. 5. The above requirements shall be regarded as minimum criteria and the City Council shall have sole discretion in the granting of on -sale intoxicating liquor licenses within the City of Golden Valley in the manner permitted by law; provided, however, that all existing on -sale intoxicating liquor licenses issued as of the date hereof shall continue to be valid notwithstanding that in their present form and operation they do not meet all of the criteria provided for herein but subject nevertheless to the continuing authority of the City Council respecting the revocation or renewal of any such existing license in the manner provided for and permitted by law.
