Member Stockman introduced and read the following resolution and moved its
adoption:
RESOLUTION REGARDING APPLICATION OF MGM LIQUOR WAREHOUSE, INC.
FOR OFF -SALE INTOXICATING LIQUOR LICENSE
BE IT RESOLVED by the City Council of the City of Golden Valley, Minnesota,
as follows:
To approve an off -sale intoxicating liquor license for MGM Liquor Warehouse,
Inc. at 6700 Wayzata Boulevard (Menard Building) in the City of Golden Valley
subject to:
a) Specific review by the State Liquor Control Commissioner on the matter
of whether MGM already has a "pecuniary interest" in another existing Golden
Valley off -sale license, M.D.L. Inc., arising out of MGM franchise agreement
with said M.D.L. Inc., as defined in and prohibited by Minnesota Statutes
340.13(3).
b) The City Attorney requesting an opinion of the Attorney General of the
State of Minnesota on the subject question set forth in paragraph (a) above.
c) The undertaking and agreement of the applicant MGM, which has been made
to this Council as a matter of public record at this Council Meeting, that upon
receipt of an unfavorable ruling from either the State Liquor Control Commissioner
or the Attorney General resulting from conditions (a) and (b) above, the
Applicant/Licensee will immediately and voluntarily suspend and terminate its
off -sale intoxicating liquor marketing and sales pursuant to this license at the
location specified herein without the necessity of formal revocation of license
proceedings by this Council.

TYie motion for the adoption of the foregoing resolution was seconded by Member
Mitchell and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Mitchell and Stockman, and the following voted against the
same: Johnson and Thorsen, whereupon said resolution was declared duly passed
and adopted, signed by the Mayor and her signature attested by the Deputy City
Clerk.
