Member Anderson introduced and read the following resolution and moved its
adoption:
RESOLUTION FOR ACCEPTANCE AND APPROVAL OF PLAN FOR
PUD #32 - OAK BROOK OFFICE PARK
WHEREAS, the City Council of the City of Golden Valley, pursuant to due
notice, has heretofore conducted a public hearing on proposed Planned Unit
Development Number 32 covering the following described tract of land:
The southerly 455 feet of the easterly 400 feet of the westerly 565.71 feet of
the southeast quarter of the northwest quarter of Section 19, Township 29, Range
24, Hennepin County, Minnesota, except the following described property:
Beginning at the intersection of the south line of the southeast quarter of the
northwest quarter and the west line of the east 45-5/7 rods of said southeast
quarter; thence westerly along said south line, a distance of 120 feet; thence
northerly parallel with said west line of the east 45-5/7 rods, a distance of
650 feet; thence easterly, parallel with said south line of the southeast
quarter a distance of 120 feet to said west line of the east 45-5/7 rods; thence
southerly along said west line to the point of beginning. Subject to that
portion taken for State Highway No. 55 and also subject to an easement for
roadway purposes over the westerly 15.0 feet. Containing 128,122 square feet
equals 2.94 acres.
WHEREAS, the City of Golden Valley is conducting a feasibility study
regarding the construction of a signal light on Trunk Highway 55 immediately
south of the above -referenced property and which signal light would require an
enlarged frontage road on the southerly portion of the above -referenced property.
WHEREAS, the City of Golden Valley owns the property lying directly to the
north of the above -referenced property and in the event that such a signal light
and enlarged frontage road are feasible, would be desirous of constructing a
signal light and enlarged frontage road in part of the southerly part of the
above -referenced property.
WHEREAS, all persons present were given the opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden
Valley that said above -referenced Planned Unit Development Number 32 be, and the
same hereby is, accepted and approved to the extent of the general plans of
development previously submitted to the City and subject to the following terms
and conditions:
1. The construction of any buildings on Planned Unit Development Number 32
shall not commence until 30 days after the completion of the City's feasibility
study regarding the proposed signal light on Trunk Highway 55 to the south of
the property or March 15, 1982, whichever comes earlier.

2. If the City determines that the signal light on Trunk Highway 55 south
of the above -referenced property is feasible, within the time limits set out
hereinabove, the applicant has agreed to an exchange of property with the City
whereby the applicant shall convey to the City the necessary amount of its
property for an enlarged frontage road required for the signal light and the
City shall convey to the applicant an equivalent amount of property on the north
of said property. In the event that said property exchange takes place, the
buildings that are contemplated by this Planned Unit Development shall be
constructed in the same manner and with all the same detail as contained on the
general plans of development previously submitted except that they shall be
located directly north of the location indicated on said plans for development
distant the same number of feet as the north -south dimension of the property
conveyed to the City.
3. If the City fails to determine to construct the signal and enlarged
frontage road by the time limitations set forth hereinabove, the applicant shall
proceed to construct PUD 32 in accord with this approval and a use permit to be
issued by the City Staff.
BE IT ALSO RESOLVED by the City Council of the City of Golden Valley, that
the City staff is hereby directed to prepare a use permit incorporating said
general plans of development, the requirements of all applicable ordinances, laws
and regulations, and the foregoing terms and conditions, which use permit shall
be returned to the City Council for final review and issuance.

The motion for the adoption of the foregoing resolution was seconded by Member
Johnson and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Johnson, Mitchell, Stockman and Thorsen, and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and her signature attested by the Deputy
City Clerk.
