#82-009 02-02-82 Blight Ewald Property Surround Neighborhood228 Resolution 82-9 February 2, 1982 Member Stockman introduced and read the following resolution and moved its adoption: RESOLUTION FINDING THE EWALD PROPERTY IN GOLDEN VALLEY TO BE BLIGHTED AND A BLIGHTING INFLUENCE ON THE SURROUNDING NEIGHBORHOOD WHEREAS, the Ewald property in Golden Valley, described as Lots 1 and 2, Block 1, and Lots 9, 10, 12, 13, 14 and that part of Lot 8 lying north of the south 30 feet thereof, and that part of Lot 11 lying west of the east 30 feet thereof, Block 3, McNair Manor, in the northwest and southwest quadrants of the intersection of Golden Valley Road and Xerxes Avenue North, has been vacated by the bankrupt Ewald Dairy; and WHEREAS, the commercial parking lot use of the Ewald property in Golden Valley was a nonconforming use incompatible with the surrounding residential neighborhood; and WHEREAS, the abandoned parking lot on the Ewald property in Golden Valley has become a nuisance, a hazard and an eyesore due to deterioration, abandonment of an underground fuel tank, accumlation of debris, and use as a playground and juvenile gathering place; and WHEREAS, it has been determined that private initiative to redevelop the Ewald property in Golden Valley is not economically feasible under current financial conditions; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden Valley, that the City Council finds, determines and declares the following: 1. The Ewald property in the City of Golden Valley, described as Lots 1 and 2, Block 1, and Lots 9, 10, 12, 13, 14, and that part of Lot 8 lying north of the south 30 feet thereof, and that part of Lot 11 lying west of the east 30 feet thereof, Block 3, McNair Manor, in the northwest and southwest quadrants of the intersection of Golden Valley Road and Xerxes Avenue North, consisting of unused parking lot which, by reason of deleterious land use, abandonment, obsolescense, deterioration, hazardous conditions, and stagnant and unproductive condition of land, is detrimental to the safety, health, morals and welfare of the community, constitutes blight and a cause of blight as referred to in Minnesota Statute Sections 462.411 to 462.711. 2. The Ewald property in the City of Golden Valley, by reason of abandonment, deterioration, and use as a dumping ground and juvenile gathering place, constitutes blight and a blighting influence on the surrounding residential neighborhood, warranting a project designated to eliminate scattered detrimental conditions of blight and physical decay in accordance with HUD Rules and Regulations 570.302 (e) (2). 3. Private redevelopment of the Ewald property in Golden Valley is economically unfeasible, and fulfillment of the need for elimination of the blight constituted by the Ewald property cannot be met through reliance solely upon private initiative, per Minnesota Statute 462.415 Subd. 2. 4. The Ewald property in Golden Valley, designated a deteriorated area and a blighting influence on the surrounding neighborhood, requires acquisition and clearance, as provided in Minnesota Statute Sections 462.411 to 462.711.
