Member Johnson introduced and read the following resolution and moved its
adoption:
RESOLUTION ESTABLISHING LIQUOR LICENSE VIOLATION GUIDELINES
WHEREAS, pursuant to the provisions of Section 300:70 of the City Code the
City Council for the City of Golden Valley must make a determination of whether
violations of the City's liquor laws were "willful", for the purpose of determining
whether revocation or suspension of a license should be the appropriate action;
and
WHEREAS, if the violation is determined by the City Council to be "not
willful" then the Council has the discretion to determine that the license shall
be suspended and the further discretion to determine the length of the suspension
(provided that a suspension must be for a minimum of five days) and the dates
upon which suspension shall be imposed; and
WHEREAS, the City Council is desirous of developing guidelines which will
assist in uniformity of treatment of suspensions from one case to the next,
NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Golden
Valley that guidelines are hereby adopted with respect to various types of
violations of the City's liquor laws as follows:
1. Non -willful violations involving sale of liquor to minors shall result
in a five (5) day suspension of the license privilege; non -willful violations of
all other types of City liquor laws shall result in a suspension for a period of
ten (10) days.
2. The suspension period for all non -willful violations of the City's
liquor laws shall begin on the Monday following the Council meeting at which the
findings of a non -willful violation was made, and shall run for consecutive
business days until the determined suspension period shall have elapsed.
3. Notwithstanding paragraph number two (2) above no suspsension period
shall commence in or cover any portion of a week during which a national holiday
shall occur, but after the completion of any such holiday week the suspension
shall commence to run on the next Monday thereafter.
4. While the foregoing are intended to be the general guidelines which
the City Council will follow in most similar circumstances the City Council
never -the -less reserves the right to make exceptions to and deviate from the
same as unusual or other meritorious factors may in the sole judgement of the
Council so indicate.

The motion for the adoption of the foregoing resolution was seconded by Member
Stockman and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Johnson, Mitchell, Stockman and Thorsen, and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and her signature attested by the Deputy
City Clerk.
