Member Anderson introduced and read the following resolution and moved its
adoption:
RESOLUTION AUTHORIZING AND DIRECTING THE BASSETT CREEK FLOOD CONTROL
COMMISSION TO PREPARE AN AMENDED JOINT POWERS AGREEMENT AND A PLAN
TO REORGANIZE THE COMMISSION TO COMPLY WITH SURFACE WATER
MANAGEMENT LEGISLATION ADOPTED BY THE 1982 MINNESOTA LEGISLATURE
WHEREAS, the Minnesota Legislature has adopted S.F. 1451 which was signed
into law by the Governor on March 22, 1982; and
WHEREAS, said Legislature mandates the creation of a watershed management
organization; and
WHEREAS, the watershed management organization has responsibilities under
said act to proceed in areas not currently authorized by the Joint Powers
Agreement creating the Bassett Creek Flood Control Commission; and
WHEREAS, it is necessary that a watershed management organization with
proper powers be in existence by December 31, 1983 or the responsibility for
surface water management will be transferred to the County who will then create
a watershed district to manage the watershed; and
WHEREAS, the Bassett Creek Flood Control Commission has been a joint and
cooperative effort of this City along with eight other cities for the past 14
years and the Bassett Creek Flood Control Commission has ordered improvements
and prepared plans for watershed management; and
WHEREAS, this City along with the other cities has a substantial investment
in the Commission and in the plans prepared and adopted for management of surface
water; and
WHEREAS, the city has had a good working relationship with the Bassett
Creek Flood Control Commission and believes it is in the public interest to
continue that Commission;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden
Valley as follows:
1. The Bassett Creek Flood Control Commission is authorized and encouraged
to prepare an amended Joint Powers Agreement to bring it into conformance with
M.S. Section 473.877 as a watershed management organization. Upon completion of
the proposed amended Joint Powers Agreement we request that the Commission submit
the amended agreement to this Council for our further consideration.
2. In the preparation of the amended agreement the Bassett Creek Flood
Control Commission is authorized to structure itself in such a manner that it
can prepare the watershed plan required by the act.
3. The City Manager and the City Engineer are authorized and directed to
cooperate with the Bassett Creek Flood Control Commission in the preparation of
an amended Joint Powers Agreement and to prepare a plan which will bring this
City into conformance with the mandated requirements of the new act relating to
surface water management and they are further directed to keep this Council
advised as the planning proceeds.

The motion for the adoption of the foregoing resolution was seconded by Member
Johnson and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Johnson, Mitchell, Stockman and Thorsen, and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and her signature attested by the Deputy
City Clerk.
