83-012 - 03-01 Authorize Purchase Easement Public Right-of-Way 83 SS 1Resolution 83-12 March 1, 1983 Member Stockman introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING THE ACQUISITION BY PURCHASE OR CONDEMNATION OF CERTAIN EASEMENTS FOR PUBLIC RIGHT-OF-WAY (83 SS 1) WHEREAS, it appears that it is necessary and desirable to acquire the easements hereinafter described to be used as public right-of-way for the construction and maintenance of utilities thereon; and WHEREAS, the acquisition of said easements through direct purchase or condemnation appears to be desirable and reasonable; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden Valley, that the lands hereinafter described be acquired by purchase or condemnation, and the Mayor, City Manager, City Clerk and City Attorney are hereby authorized and directed to take all necessary steps and to execute all necessary documents in connection with the acquisition of said easements as described below, to -wit: A perpetual easement for drainage and utility purposes in, on, over and across all of Tract B, Registered Land Survey No. 1293. A temporary construction easement in, on, over and across the east 15.0 feet of Tract A, Registered Land Survey No. 1059. A temporary construction easement in, on, over and across the west 5.0 feet of the north 150.0 feet of Lot 2, Block 4, Golden Valley Industrial Park. A temporary construction easement in, on, over and across the west 15.0 feet of Lot 1, Block 4, Golden Valley Industrial Park. A perpetual easement for drainage and utility purposes and a temporary construction easement in, on, over and across the following described property: Tract A, Registered Land Survey No. 1233. Said perpetual easement is described as follows: The easterly 5.0 feet of said Tract A, together with all that part of said Tract A lying easterly of the following described line: Commencing at a point in the southerly line of said Tract A a distance of 28.0 feet westerly of the southeast corner thereof; thence running northerly to a point in the easterly line of said Tract A, a distance of 70.0 feet northwesterly of the southeast corner of said Tract A, as measured along the easterly line of said Tract A, and said line there terminating. Said temporary construction easement is described as follows: The easterly 20.0 feet of said Tract A, together with all that part of said Tract A lying easterly of the following described line: Resolution 83-12 - Continued (larch 1, 1983 Commencing at a point in the southerly line of said Tract A a distance of 40.0 feet westerly of the southeast corner thereof; thence running northerly to a point in the easterly line of said Tract A, a distance of 100.0 feet northwesterly of the southeast corner of said Tract A, as measured along the easterly line of said Tract A, and said line there terminating. A perpetual easement for drainage and utility purposes in, on, over and across the west 15.0 feet of all that part of Lot 5, Block 1, Golden Valley Industrial Park lying west of the east 194.42 feet thereof and easterly of Registered Land Survey No. 1293 together with a temporary construction easement in, on, over and across the west 30.0 feet of all that part of Lot 5, Block 1, Golden Valley Industrial Park lying west of the east 194.42 feet thereof and easterly of Registered Land Survey No. 1293. And also a temporary construction easement in, on, over and across the north 40.0 feet of the west 60.0 feet of all that part of Lot 5, Block 1, Golden Valley Industrial Park lying west of the east 194.42 feet thereof and easterly of Registered Land Survey No. 1293. A temporary construction easement in, on, over and across all that part of the following described tract of land lying easterly of a line that is 20.0 feet west of and parallel with the east line of Tract A, Registered Land Survey No. 1293: Commencing at the northeasterly corner of Lot 7, Block 1, Ravenhorst No. 2, thence east to the northwesterly corner of Registered Land Survey No. 1293, thence southerly and southwesterly along the westerly line of said Registered Land Survey to its most westerly corner thereof, thence northwesterly to the most southerly corner of said Lot 7, thence northeasterly and northerly along the easterly line of said Lot 7 to the beginning. A perpetual easement for drainage and utility purposes, in, on, over and across that part of the Chicago Northwestern Railroad right-of-way described as follows: All that part of said railroad right-of-way lying southerly of the center line of said right-of-way and westerly of a line that is 50.0 feet east of and parallel with the northerly extension of the west line of Golden Valley Industrial Park. BE IT FURTHER RESOLVED that the independent appraisals of the above-described easements which shall be obtained as required by applicable Minnesota law be transmitted to the owners of said properties and that offers to purchase said easements be made to the said owners for the amounts of said appraisals; and BE IT FURTHER RESOLVED that in the event any of the above-described easements cannot be acquired by negotiated purchase pursuant to said appraisals, the appropriate officers of the City described above be authorized and directed to commence the appropriate condemnation proceedings; and BE IT FURTHER RESOLVED that the acquisition of the above-described easements is necessary and desirable, and the purposes aforesaid for which said easements are to be acquired are proper and necessary public purposes.
