Member Johnson introduced the following resolution and moved its adoption:
RESOLUTION CALLING FOR INVESTIGATION OF
RECENT ACTIONS OF PERA BOARD OF DIRECTORS
WHEREAS, the recent appointment of John Allers as Interim Executive Director
of the Public Employees Retirement Association (PERA) Pension Fund was reportedly
made without proper public consideration by the PERA Board of Directors; and
WHEREAS, the decision to appoint Allers was reportedly made at a secret
meeting by an eight member majority of the PERA Board of Directors; and
WHEREAS, PERA Board Member Morris Anderson has sued these eight members, as
private citizens, for violating the Minnesota Open Meeting Law; and
WHEREAS the eight board members being sued as private citizens have voted
to use public funds to defend themselves, against the advice of the Attorney
General's Office; and
WHEREAS, the City Council of the City of Golden Valley believes this proposed
use of public funds to be entirely inappropriate;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Golden Valley strongly urges the PERA Board of Directors to rescind its appointment
of John Allers and its decision to use public funds for private legal defense,
and proceed to implement a proper selection process; and
BE IT FURTHER RESOLVED, in order to restore both member and public confidence
in PERA, the City Council of the City of Golden Valley requests the Minnesota
Legislature to authorize an impartial and objective investigation into the
propriety and legality of actions taken by the PERA Board of Directors and
administration during the most recent five-year period.

The motion for the adoption of the foregoing resolution was seconded by Member
Thompson and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Bakken, Johnson, Stockman and Thompson, and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and her signature attested by the Deputy
City Clerk.
