86-022 - 04-01 Reconveying Tax Forfeit Lands back to the State Resolution 86-22 April 1, 1986
Member Thompson introduced the following resolution and moved its adoption:
RESOLUTION RECONVEYING CERTAIPJ TAX FORFEIT LANDS BACK
TO TNE STATE AND REQUESTING THE COUNTY BOARD TO IMPOSE
CONDITIONS ON THE SALE OF SAID TAX FORFEIT LANDS
WHEREAS, pursuant to Minnesota Statutes, Section 282.01, Subdivision 1, the
State of Minnesota, as trustee under Minnesota Statutes, Section 281.25 on the
6th day of April , 1979, conveyed to the City of Golden Valley, a governmental
subdivision, certain lands, of which the lands hereinafter described are a portion,
to be used for an authorized public use; and
WHEREAS, said governmental subdivision has failed to put the lands hereinafter
described to the public use for which it was conveyed and the governing body
thereof has authorized the proper officers to convey the same to the State of
Minnesota, as such trustee; and
WHEREAS, the City wishes to restrict and condition the sale of the lands
hereinafter described to bring them into conformance with City ordinances and

NOW, THEREFORE, this indenture, made this lst day of April , 1986, between
the City of Golden Valley, a governmental subdivision of the State of Minnesota,
as party of the first part, and the State of Minnesota, as trustee as hereinafter
set forth, as party of the second part;
1. That the said party of the first part, in consideration of the premises
and other valuable considerations, the receipt whereof is hereby acknowledged,
does hereby Grant, Bargain, Quitclaim and Reconvey unto the said party of the
second part all the tract or parcel of land lying and being in the County of
Hennepin in the State of Minnesota, described as follows, to-wit:
That part of Outlot A, P1ary Hills Park, embraced in the following described
tract: Commencing at the Southeast corner of the Northeast Quarter of the
Northeast Quarter of Section 18 Township 29 Range 24; Thence West 294.01 feet;
Thence at an angle to the right of 47 Degrees 50 Minutes a distance of 280 feet
to actual point of beginning; Thence Northeasterly at right angles 202.91 feet;
Thence Northwesterly to most easterly corner of Lot 7, Block 2, Cumberland
Hills, 3rd Addition; Thence Southwesterly to most southerly corner of Outlot
Three, Cumberland Hills, 3rd Addition; Thence Southeasterly to beginning.
in trust as provided by Minnesota Statutes, Section 281.25, upon like conditions
and with like effect as if said lands had not been conveyed to said party of the
first part as aforesaid;
2. The County Board is hereby requested to impose conditions on the sale
of the following described lands, and is further requested to sell such lands to
the City of Golden Valley at a non-public sale so that said lands will be combined
for land use purposes with adjacent City owned land:

That part of Outlot A, Mary Hills Park, embraced in the following described
tract: Commencing at the Southeast corner of the Northeast Quarter of the
Northeast Quarter of Section 18 Township 29 Range 24; Thence ��est 294.01 feet;
Thence at an angle to the right of 47 Degrees 50 Minutes a distance of 280 feet
to actual point of beginning; Thence Pdortheasterly at right angles 202.91 feet;
Thence Northwesterly to most easterly corner of Lot 7, Block 2, Cumberland
Hills, 3rd Addition; Thence Southwesterly to most southerly corner of Outlot
Three, Cumberland Hills, 3rd Addition; Thence Southeasterly to beginning.
3. The �1ayor and City Clerk are hereby authorized and di rected to release
the aforementioned lands for sale, subject to the County imposing the aforestated
conditions.
TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and
appurtenances thereunto belonging or in any wise appertaining, to the said party
of the second part and its successors and assigns, Forever.

The motion for the adoption of the foregoing resolution was seconded by P�ernber
Stockman and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Bakken, Johnson, Stockman and Thompson; and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the R1ayor and her signature attested by the Deputy
City Clerk.
