86-049 - 07-01 Acquisition of Easements for Construction of Wisconsin Ave Resolution 86-49 July 1, 1986
Member Bakken introduced the following resolution and moved its adoption:
RESOLUTION AUTHORIZING THE ACQUISITION BY PURCHASE OR CONDEP•1NATION
OF CERTAIN PERMANENT ANND TEh1PORARY EASEPIENTS FOR THE CONSTRUCTION
OF WISCONSIN AVENUE AND CERTIFYIPJG THE VALUE THEREOF
WNEREAS, it appears that it is necessary and desirable to acquire the
easements hereinafter described for the purpose of locating and maintaining
thereon public roads, streets, drainage ways and utilities; and
WHEREAS, the acquisition of said ease�ents through direct purchase or
condemnation appears to be desirable and reasonable;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden
Valley, that the easements hereinafter described be acquired by purchase or
condemnation, and the Flayor, City hlanager, City Clerk and City Attorney are
hereby authorized and directed to take all necessary steps and to execute all
necessary documents in connection with the acquisition of said easements, to-wit:
Perpetual easements for road, street, drainage and utility purposes in, on, over
and across the following described property:
The East 35.0 feet of Lot 10, Busch 's Golden Valley Acres, in Hennepin
County, I�li nnesota.
and a temporary construction easement for roadway purposes across the following
described property: All that part of Lot 10, Busch's Golden Valley Acres lying
easterly of the following described line:
Beginning at a point on the south line of said Lot 10 distant 67.0 feet west of
the southeast corner of said lot; thence northeasterly to a point on the north
line of said Lot 10 distant 40.0 feet west of the northeast corner of said Lot
10, and said line there terminating, except the east 35.0 feet thereof.
BE IT FURTHER RESOLVED that the value of said easements are certified to be
$27,000; and
BE IT FURTHER RESOLVED that the independent appraisal of the above-described
easer�ents which has been obtained as required by applicable Plinnesota law be
transmitted to the owner of said property and that offers to purchase said
property be made to the said owner for the amounts of said appraisal ; and
BE IT FURTHER RESOLVED that in the event any of the above-described
easements cannot be acquired by negotiated purchase pursuant to said appraisal ,
the appropriate officers of the City described above be authorized and directed
to commence the appropriate condemnation proceedings; and
BE IT FURTHER RESOLVED that the acquisition of the above-described easements
is necessary and desirable, and the purposes aforesaid for which said easements
are to be acquired are proper and necessary public purposes.

The motion for the adoption of the foregoing resolution was seconded by Member
Johnson and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Bakken, Johnson, Stockman and Thompson; and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and her signature attested by the Deputy
City Clerk.
