86-079 - 10-21 Certifying Value for Acquisition of Property for Utility Purposes Resolution 86-79 October 21, 1986
Member Thompson introduced the following resolution and moved its adoption:
RESOLUTION CERTIFYING TNE VALUE FOR ACQUISITION BY
PURCHASE OR CONDEP4NATION OF CERTAIfd REAL PROPERTY
FOR STREET RIGHT-OF-WAY, DRAINAGE A�JD UTILITY PURPOSES
WHEREAS, the City Council of the City of Golden Valley has determined that
it is necessary to acquire certain real property for street right-of-way, drainage
and utility purposes; and
WHEREAS, Resolution 86-18, adopted March 4, 19II6 authorized the purchase or
condemnation of said certain real property; and
WHEREAS, the City has obtained an appraisal of market value of said property.
NOW, TNEREFORE, BE IT RESOLVED, by the City Council of the City of Golden
Valley that it hereby certifies the market value of the following property to be
$28,000, such value being set for the purpose of making an offer to purchase or
acquire by condemnation:
The East 35.0 feet of Lot 10, Busch 's Golden Valley Acres, in Hennepin
County, Minnesota.
A Temporary Construction easement for roadway purposes across the following
described property: All of that part of Lot 10, Busch's Golden Valley
Acres lying easterly of the following described line:
Beginning at a point on the south line of said Lot 10 distant 67.0 feet west
of the southeast corner of said lot; thence northeasterly to a point on the
north line of said Lot 10 distant 40.0 feet west of the northeast corner of
said Lot 10, and said line there terminating, except the east 35.0 feet thereof.
BE IT FURTHER RESOLVED, that the market value is considered the amount that
would be paid to a willing seller by a willing buye r presuming special assessments,
liens and other encumbrances, if any, are paid by the seller prior to transfer
of title and di sregardi ng any before value of the property caused by the proposed
improvements.

The motion for the adoption of the foregoing resolution was seconded by Plember
Bakken and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Bakken, Johnson, Stockman and Thompson; and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the hlayor and her signature attested by the Deputy
City Clerk.
