86-082 - 11-05 Acquisition of Property for Easements for 86 SS 1 Resolution 86-82 November 5, 1986 Member Thompson introduced the following resolution and moved its adoption: RESOLUTIOf�I AUTHORIZING THE ACQUISITION BY PURCHASE OR CONDEP�NATION OF CERTAIN PROPERTY FOR EASEh�1ENTS FOR DRAINAGE AND UTILITY PURPOSES 86 SS 1 WHEREAS, it appears that it is necessary and desirable to acquire the easements hereinafter described for drainage and utility purposes and for the purpose of temporary construction adjacent to the storm sewer; and WHEREAS, the acquisition of said easenents through direct purchase or condemnation appears to be desirable and reasonable; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden Valley that the lands hereinafter described be acquired by purchase or condemnation, and the P�ayor, City Manager, City Clerk and City Attorney are hereby authorized and directed to take all necessary steps and to execute all necessary documents in connection with the acquisition of said easements to-wit: Perpetual easements for drainage and utility purposes and temporary construction easements in, on, over and across the following described property: PARCEL 1 All that part of Lot 2, Block 4, Rearrangement of Lots 15, 16 and 17 Yale Garden Homes, Hennepin County, Minnesota, lying westerly of the following described line: Commencing at the northwest corner of said Lot 2; thence Southeasterly to a point in the south line of said Lot 2, a distance of 15.0 feet East of the southwest corner thereof, as measured along said south line, and said line there terminating. Together with a temporary construction easement over, under and across the Westerly 20.0 feet of said Lot l. Said temporary construction easement to expire on June 12, 1987. PARCEL 2 The West 668.32 feet of Lot 16, except the North 97.33 feet thereof, also the North 48.66 feet of the 4Jest 668.32 feet of Lot 15, all in Yale Garden Homes, Hennepin County, Minnesota. Said easement is described as all that part of the above described property lyi ng Easterly of the fol lowi ng described li ne: Commencing at a point in the north line of the above described prope rty, a distance of 12.0 feet West of the northeast corner thereof, as measured along said north line, thence Southerly to a point in the south line of the above described property a distance of 6.0 feet West of the southeast corner thereof, as measured along the south line thereof, and said line there terminating. Together with a temporary construction easement over, under, and across the Easterly 15.0 feet of the above described property; said temporary easement to expire on June 12, 1987. Resolution 86-82 - Continued November 5, 1986 PARCEL 3 The South 82.34 feet of the bJest 668.32 feet of Lot 15, "Yale Garden Homes", except the West 170 feet thereof taken for state highway purposes, Hennepin County, P1i nnesota. Said easement is described as all that part of the above described property lying Easterly of the following described line: Commencing at a point in the north line of the above described property a distance of 6.0 feet West of the northeast corner thereof, as measured along said north line; thence Southerly to the southeast corner of the above described property, and said line there terminating. Together with a temporary construction easement, over, under and across the Easterly 15.0 feet of the above described property; said temporary easement to expire on June 12, 1987. PARCEL 4 The Easterly 15.0 feet of the West 1/2 of Lot 14, Yale Garden Homes, Hennepin County, P�li nnesota. Together with a temporary construction easement over, under and across the Easterly 30.0 feet of the above described property; said temporary easement to expire on June 12, 1987. PARCEL 5 The Easterly 15.0 feet of the North 3/4 of the 4Jest 1/2 of Lot 13, "Yale Garden Homes" , except the West 170 feet thereof, Hennepin County, tn1innesota. Together with a temporary construction easement over, under and across the Easterly 30.0 feet of the above described property; said temporary easement to expire on June 12, 1987. PARCEL 6 The Easterly 15.0 feet of the South 1/4 of West 1/2 of Lot 13, and the North 1/2 of West 1/2 of Lot 12, "Yale Garden Homes", except the West 170 feet thereof, Hennepi n County, f�9i nnesota. Together with a temporary construction easement over, under and across the Easterly 30.0 feet of the above described property; said temporary easement to expire on June 12, 1987. PARCEL 7 The Westerly 15.0 feet of the following described property: Lot l, Block l , except the t,lest 8 feet thereof, R. W. Wormsbecker Addition, Hennepi n County, P1i nnesota. Together with a temporary construction easement over, under and across the Westerly 30.0 feet of the above described property; said temporary easement to expire on June 12, 1987. Resolution 86-82 - Continued November 5, 1986 BE IT FURTHER RESOLVED that the independent appraisals of the above-described easements which shall be obtained as required by applicable P�1innesota law be transmitted to the owners of said properties and that offers to purchase said easements be made to the said owners for the amounts of said appraisals; and BE IT FURTHER RESOLVED that in the event any of the above-described easements cannot be acquired by negotiated purchase pursuant to said appraisals, the appropriate officers of the City described above be authorized and di rected to commence the appropriate condemnation proceedings; and BE IT FURTHER RESOLVED that the acquisition of the above-described land is necessary and desirable, and the purposes aforesaid for which said lands are to be acquired are proper and necessary public purposes. �, � � , � ary . nderson, layor ATTEST: � t : � ��_� u y Na y, Deput City Clerk The motion for the adoption of the foregoing resolution was seconded by �1ember Johnson and upon a vote being taken thereon, the following voted in favor thereof: Anderson, Bakken, Johnson, Stockman and Thor�pson; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the Deputy City Clerk.
