89-033 - 05-16 Authorize Purchase of Street Right-of-way TH 55 Frontage RoadResolution 89-33 May 16, 1989 Member Johnson introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING THE ACQUISITION BY PURCHASE OR CONDEMNATION OF CERTAIN REAL PROPERTY FOR STREET RIGHT-OF-WAY FOR HIGHWAY 55 FRONTAGE ROAD WHEREAS, the City of Golden Valley is in the process of constructing frontage roads on the north and south side of Highway 55 east of its intersection with Highway 100 in the City of Golden Valley; and WHEREAS, it is necessary and desirable and in the public interest for the City to acquire the real property set out in Exhibit A attached hereto for street right-of-way for the frontage road; NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Golden Valley: 1. That it is necessary and desirable and in the public interest to acquire the real property described on Exhibit A attached hereto for street right-of-way purposes for the Highway 55 frontage roads and the City staff and City attorney, or such other persons as necessary, are hereby authorized and directed to take all necessary steps and to execute all necessary documents to acquire such real property; 2. That in the event that the real property described on Exhibit A cannot be expeditiously acquired by negotiated purchase, the City staff and City attorney for the City of Golden Valley are authorized and directed to commence condemnation proceedings to acquire such property; and 3. That the acquisition of such real property is necessary and desirable and the purposes therefore are proper and necessary public purposes. Mary E. Resolution 89-33 - Continued EXHIBIT A EASEMENT NO. 5 PIN NO. 19-29-24-31-0006 May 16, 1989 A Perpetual Easement for Street Right -Of -Way over, under and across that part of the Southwest Quarter of Section 19, Township 29, Range 24, Hennepin County, Minnesota, described as follows: The West 125 feet of the East 825 feet of that part of the North 709.5 feet of the Northeast 1/4 of the Southwest 1/4 lying East of a line described as beginning at a point on the North line of the Southwest 1/4 distant 1639 feet East of the Northwest corner of the Southwest 1/4; thence South at right angles to said North line 291 feet; thence deflecting to the left 7 degrees 50 minutes to its intersection with a line running parallel to and 709.5 feet South of said North line; except that part thereof lying South of the Northwesterly right-of-way line of the Minneapolis, Northfield and Southern Railway, in Section 19, Township 29, Range 24, according to the Government Survey thereof. Said Perpetual Easement being that part of the above described Parcel lying Northerly of the following described line.
