Member Johnson introduced the following resolution and moved its adoption:
RESOLUTION AUTHORIZING THE ACQUISITION BY PURCHASE
OR CONDEMNATION OF CERTAIN REAL PROPERTY FOR
STREET RIGHT-OF-WAY FOR HIGHWAY 55 FRONTAGE ROAD
WHEREAS, the City of Golden Valley is in the process of constructing
frontage roads on the north and south side of Highway 55 east of its
intersection with Highway 100 in the City of Golden Valley; and
WHEREAS, it is necessary and desirable and in the public interest for the
City to acquire the real property set out in Exhibit A attached hereto for
street right-of-way for the frontage road;
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Golden
Valley:
1. That it is necessary and desirable and in the public interest to
acquire the real property described on Exhibit A attached hereto for
street right-of-way purposes for the Highway 55 frontage roads and the
City staff and City attorney, or such other persons as necessary, are
hereby authorized and directed to take all necessary steps and to
execute all necessary documents to acquire such real property;
2. That in the event that the real property described on Exhibit A cannot
be expeditiously acquired by negotiated purchase, the City staff and
City attorney for the City of Golden Valley are authorized and directed
to commence condemnation proceedings to acquire such property; and
3. That the acquisition of such real property is necessary and desirable
and the purposes therefore are proper and necessary public purposes.

The motion for the adoption of the foregoing resolution was seconded by Member
Thompson and upon a vote being taken thereon, the following voted in favor
thereof: Anderson, Bakken, Johnson, Stockman and Thompson; and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and her signature attested by the Deputy
City Clerk.

A Perpetual Easement for Street Right -Of -Way over, under and across that
part of the Southwest Quarter of Section 19, Township 29, Range 24, Hennepin
County, Minnesota, described as follows:
The West 125 feet of the East 825 feet of that part of the North 709.5 feet
of the Northeast 1/4 of the Southwest 1/4 lying East of a line described as
beginning at a point on the North line of the Southwest 1/4 distant 1639
feet East of the Northwest corner of the Southwest 1/4; thence South at
right angles to said North line 291 feet; thence deflecting to the left 7
degrees 50 minutes to its intersection with a line running parallel to and
709.5 feet South of said North line; except that part thereof lying South
of the Northwesterly right-of-way line of the Minneapolis, Northfield and
Southern Railway, in Section 19, Township 29, Range 24, according to the
Government Survey thereof.
Said Perpetual Easement being that part of the above described Parcel lying
Northerly of the following described line.
Commencing at the Northeast corner of Lot 6, Block 1 Clover Leaf Terrace;
thence North 89 degrees 48 minutes 45 seconds West, assumed bearing along
the Northerly line of said Lot 6 a distance of 57.29 feet; thence North 3
degrees 28 minutes 22 seconds East, a distance of 25.95 feet to the point
of beginning of the line to be described; thence South 86 degrees 31
minutes 38 seconds East a distance of 891.99 feet; thence Southeasterly a
distance of 99.49 feet along a tangential curve concave to the Southwest
having a radius of 452.46 feet and a central angle of 12 degrees 35 minutes
57 seconds; thence Southeasterly a distance of 204.48 feet along a tangen-
tial curve concave to the Northeast, having a radius of 438.50 feet and a
central angle of 26 degrees 43 minutes 00 seconds; thence Northeasterly
70.38 feet along a tangential curve concave to the Southeast having a
radius of 388.50 feet and a central angle of 10 degrees 22 minutes 48
seconds; thence North 89 degrees 44 minutes 05 seconds East a distance of
228.33 feet and there terminating.
