92-057 - 07-07 Order Waiver Public Hearing 91 SS 5 Meadow LaneResolution 92-57 July 7, 1992 Member Thompson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS UPON WAIVER OF PUBLIC HEARING UNDER MINNESOTA STATUTES 429.031, SUBD. 3 91 SS 5 (MEADOW LANE, BETWEEN LEBER LANE AND POPLAR DRIVE) WHEREAS, all the owners of real property affected by the above proposed public improvements and abutting upon any street named as the location of said improvement have petitioned the Council to construct the improvements and to assess the entire cost against their property; and WHEREAS, the Council is fully advised of the pertinent facts, including the nature of and necessity for this public improvement; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden Valley, Minnesota, as follows: 1. That a public hearing is not necessary pursuant to Minnesota Statutes 429.031, Subd. 3. 2. That construction of the proposed public improvement shall proceed in accordance with the description of said improvement contained in the petition and waiver of right to public hearing. 3. That the public improvement is feasible. (The City reserves the right to consolidate said improvement with such other improvements as it may deem advisable to do.) 4. The cost of said improvement shall be paid out of special assessments to be levied as authorized by law, and specified in said petition. 5. The City Engineer is hereby designated as engineer for the construction of said proposed public improvement and is hereby authorized, ordered and instructed to cause said improvement to be installed in conformance with said petition. 6. The City Engineer is further instructed to amend the construction contract for public improvement 91 SI 4 by way of change order to allow for expediency of construction requested by said ATTEST: irley J N is n, City Clerk The motion for the adoption of the foregoing resolution was seconded by Member Russell, and upon a vote being taken thereon, the following voted in favor thereof: Bakken, Johnson, Russell, Stockman and Thompson; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk.
