Member Stockman introduced the following resolution and moved its adoption:
RESOLUTION WAIVING PUBLIC HEARING AND AUTHORIZING
THE CONSTRUCTION OF AND ASSESSMENT FOR
SANITARY SEWER EXTENSION
93 LF 1
(9105 MEDICINE LAKE ROAD)
WHEREAS, the City of Golden Valley, Minnesota (the "City") has been peti-
tioned by residents of the City to construct a sanitary sewer and all associated
improvements as set forth in the attached Exhibit A (the "Improvements"); and
WHEREAS, all owners of property abutting the Improvements have petitioned
the City for construction of the Improvements; and
WHEREAS, the costs of the Improvements are estimated to be $12,741.00 and
the petitioning residents have agreed to pay for assessments to cover the costs
of said Improvements up to $1,650.00, assessed over a period of not less than 5
years at not greater than 7% interest; and
WHEREAS, the residents of the City who have agreed to be assessed for the
Improvements, along with the percentage of the cost of the Improvements to be
assessed against each, are set forth in attached Exhibit B; and
WHEREAS, the parties to be assessed have agreed to the assessments and have
agreed to waive any public hearing or appeal on the assessments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY AS FOLLOWS:
1. It is hereby found that all owners abutting and benefited by the
Improvements have petitioned the City for the Improvements and have agreed to
assessments to cover their benefited portion of said Improvements up to
$1,650.00, assessed over a period of not less than 5 years at a per annum of not
greater than 7% per annum, without the City conducting a public hearing.
2. That the City does hereby agreed to construct the Improvements as set
forth in attached Exhibit A to be assessed against the parties in the amounts
set forth in attached Exhibit B over a period of 5 years at 7% per annum.

The motion for the adoption of the foregoing resolution was seconded by Member
Johnson, and upon a vote being taken thereon, the following voted in favor
thereof: Bakken, Johnson, Russell, Stockman and Thompson; and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and his signature attested by the City
Clerk.

EXHIBIT "B"
PETITION & AGREEMENT
The undersigned landowners ("Landowners") hereby
City of Golden Valley, Minnesota ("City") as follows
obligations set out below:

1. The Landowners represent all adjacent landowners to the
proposed sanitary sewer extension which is set forth in attached
Exhibit A.
2. The Landowners do hereby petition the City to construct the
sanitary sewer and all associated improvements ("Improvements") and do
hereby agree to allow the cost of the Improvements to be assessed
against the Landowners as included herein.
3. The Landowners shall only be assessed for the cost of the
Improvements up to $1,650.00.
4. The Landowners petition the Council to adopt a resolution
ordering the Improvements without a public hearing and waive any
rights to a public hearing for the Improvements and waive any rights
to appeal the assessments set forth in this Agreement.
5. The Landowners agree that the Improvements shall be built in
a manner generally consistent with that shown on Exhibit A, with such
modifications as the City may determine are appropriate.
6. The Landowners agree that the City shall assess the costs of
constructing the Improvements in the amounts agreed to herein (plus
interest at a rate of 7% per annum) over a period of not less than 5
years.
