Member Thompson introduced the following resolution and moved its adoption:
RESOLUTION AUTHORIZING THE ACQUISITION BY PURCHASE OR
CONDEMNATION OF CERTAIN REAL PROPERTY FOR STREET
RIGHT-OF-WAY AND CONSTRUCTION EASEMENTS FOR IMPROVEMENTS
TO WINNETKA AVENUE FROM HAROLD AVENUE TO ORKLA DRIVE
WHEREAS, on July 15, 1991 the City Council adopted Resolution 91-69, a
Resolution Authorizing the Acquisition by Purchase or Condemnation of Certain
Real Property for Street Right -Of -Way for Improvements to Winnetka Avenue from
Harold Avenue to Orkla Drive; and
WHEREAS, acquisitions authorized under this resolution commenced in 1991
but have not all been completed; and
WHEREAS, in response to public hearings on the proposed design of Winnetka
Avenue the City Council recommended revisions to the previous design; and
WHEREAS, engineers have implemented the recommended revisions, and defined
the extent of the the construction limits, providing new descriptions of
permanent easements and establishing temporary construction easements for a
number of parcels; and
WHEREAS, it is still necessary, desirable and in the public interest to
acquire the real property and temporary construction easements set out in
Exhibits A and B attached hereto.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Golden
Valley that:
1. It is necessary, desirable and in the public interest to acquire the
real property described in Exhibit A and temporary construction
easements described in Exhibit B, attached hereto, for street
right-of-way purposes for the Winnetka Avenue Project; and
2. The City staff and City attorney, or such other persons as necessary,
are hereby authorized and directed to take all necessary steps and
execute all necessary documents to acquire such real property and
temporary construction easements; and
3. In the event that the real property described in Exhibit A or the
temporary construction easements described in Exhibit B cannot be
expeditiously acquired by negotiated purchase, the City staff and
City attorney for the City of Golden Valley are authorized to
commence condemnation proceedings to acquire such property or
easements; and
4. The acquisition of such real property and easements is necessary
and desirable and constitutes a proper and necessary public purpose.

The motion for the adoption of the foregoing resolution was seconded by Member
Russell and upon a vote being taken thereon, the following voted in favor
thereof: Bakken, Johnson, Russell, Stockman and Thompson; and the following
voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and his signature attested by the City
Clerk.
