95-065 - 08-15 - Street Vacation of Ortler Pass Resolution 95-65 August 15, 1995 Member Russell introduced the following resolution and moved its adoption: RESOLUTION FOR STREET VACATION PORTION OF ORTLER PASS WHEREAS, the City Council has met at the time and place specified in a notice duly published with respect to the subject matter hereof and has heard all interested persons, and it appearing in the interest of the public that a portion of a street be vacated; and WHEREAS, in the best interest of the public, a perpetual drainage, utility and access easement 60 feet in width remain in place of the street at said location; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden Valley that a portion of street known as Ortler Pass, described below, which lies within the corporate limits of the City, is hereby vacated: That portion of Ortler Pass south of Tyrol Trail and abutting Lots 1, 2 and 3 of Block 6, Tyrol Hills Subdivisions, Hennepin County, Minnesota. Said lots otherwise known as 1508 Alpine Trail, 1512 Alpine Trail and 1414 Tyrol Trail. AND, BE IT FURTHER RESOLVED that a perpetual drainage, utility and access easement 60 feet in width be reserved over the entire length of said street vacation. Blair Tremere, Mayor ATTEST: Shirley J. Nelson, City Clerk The motion for the adoption of the foregoing resolution was seconded by Member Johnson and upon a vote being taken thereon, the following voted in favor thereof: Johnson, Micks, Russell, Thompson, and Tremere; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk.
