95-094 - 12-19 - Negative Declaration on the need for EIS for Schaper Recreational Site Resolution 95-94 December 19, 1995 Member Russell introduced the following resolution and moved its adoption: CITY OF GOLDEN VALLEY HENNEPIN COUNTY, MINNESOTA NEGATIVE DECLARATION ON THE NEED FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) FOR THE SCHAPER RECREATIONAL SITE WHEREAS, the City of Golden Valley is the Responsible Governmental Unit (RGU) in the processing of the Environmental Assessment Worksheet (EAV� for the proposed Schaper Recreational Site in the City of Golden Valley; WHEREAS, the EAW is based on a proposed project consisting of two alternatives: the first is construction of an active recreation area to include ball fields, open space, off- street parking, equipment storage and restroom facilities; the second is use of the site as a natural area with development limited to construction of walking and bicycle trails, picnic areas, off-street parking and restroom facilities; WHEREAS, the City has submitted a copy to all public agencies on the EAW� distribution list, provided a press release to the local paper, and published a notice of the EAW availability in the EQB Monitor on November 6, 1995, all of which were done in accordance with Minnesota Rules, Ch. 4410; WHEREAS, the thirty (30) day comment period ended December 6, 1995, with individual parties and public agencies commenting; WHEREAS, the City of Golden Valley acknowledges the responses from the Minnesota Historical Society, the Minnesota Department of Health, the Minnesota Pollution Control Agency, the Minnesota Department of Natural Resources and the Metropolitan Council; and WHEREAS, none of the commenting public agencies declared a need for an EIS on the proposed project. NOW, THERE, BE IT RESOLVED by the City Council of the City of Golden Valley that a negative declaration is made on the need for an Environmental Impact Statement (EIS) for the proposed Schaper Recreational Site in the City of Golden Valley. BE IT FURTHER RESOLVED by the City Council of the City of Golden Valley that it makes the following findings in support of its decision based on the information gathered during the EAW process, the comments received on the EAW and the responses, all of which are incorporated herein by this reference and shall be retained as a part of the record of this decision: Resolution 95-94 - Continued December 19, 1995 1. Comparing the environmental impacts that may be reasonably expected to occur from the proposed project with the criteria contained in Minnesota Rules § 4410.1700, subpart 7, the Council finds that the proposed project does not have the potential for significant environmental effects. 2. The type, extent and reversibility of environmental effects have been considered and they do not contain the potential for significant environmental effects. 3. The cumulative potential of environmental effects of related or anticipated future projects will not create the potential for significant environmental effects. 4. The extent to which the environmental effects are subject to mitigation by ongoing public regulatory authority indicates that this proposed project does not have the potential for significant environmental effects. 5. The extent to which environmental effects can be anticipated and controlled as a result of other environmental studies undertaken by public agencies and the project proposer has been considered and it indicates that this proposed project does not have the potential for significant environmental effects.
