97-016 - 02-04 Negative Declaration on EIS for Hidden Lakes PUD Resolution 97-16 February 4, 1997
Member Johnson introduced the following resolution and moved its adoption:
CITY OF GOLDEN VALLEY
HENNEPIN COUNTY, MINNESOTA
NEGATIVE DECLARATION ON THE NEED FOR AN ENVIRONMENTAL IMPACT
STATEMENT (EIS) FOR THE HIDDEN LAKES PLANNED UNIT DEVELOPMENT
WHEREAS, the City of Golden Valley is the Responsible Governmental Unit (RGU)
in the processing of the Environmental Assessment Worksheet (EAW) for the proposed
Hidden Lakes Planned Unit Development in the City of Golden Valley; and
WHEREAS, the EAW is based on a proposed project consisting of 176 housing
units (41 single family homes; 25 unattached villa homes, and 110 attached townhomes)
on approximately 68 acres, adjacent to Sweeney and Twin Lakes; and
WHEREAS, the City has submitted a copy to all public agencies on the EAW
distribution list, provided a press release to the local paper, and published a notice of the
EAW availability in the EQB Monitor on December 16, 1996, all of which were done in
accordance with Minnesota Rules, Ch. 4410; and
WHEREAS, the thirty (30) day comment period ended January 15, 1997, with
individual parties and public agencies commenting; and
WHEREAS, the City of Golden Valley acknowledges the responses from the
Minnesota Historical Society, Minnesota Department of Natural Resources, Metropolitan
Council, Minneapolis Park and Recreation Board, Sweeney Lake Homeowners
Association, Bassett Creek Water Management Organization and three individuals; and
WHEREAS, none of the commenting public agencies declared a need for an EIS on
the proposed project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden
Valley that a negative declaration is made on the need for an Environmental Impact
Statement (EIS) for the proposed Hidden Lakes Planned Unit Development in the City of
Golden Valley.
BE IT FURTHER RESOLVED by the City Council of the City of Golden Valley that it
makes the following findings in support of its decision based on the information gathered
during the EAW process, the comments received on the EAW and the responses, all of
which are incorporated herein by this reference and shall be retained as a part of the
record of this decision:

1. Comparing the environmental impacts that may be reasonably expected to occur
from the proposed project with the criteria contained in Minnesota Rules §4410.1700,
subpart 7, the Council finds that the proposed project does not have the potential for
significant environmental effects.
2. The type, extent and reversibility of environmental effects have been considered
and they do not contain the potential for significant environmental effects.
3. The cumulative potential of environmental effects of related or anticipated future
projects will not create the potential for significant environmental effects.
4. The extent to which the environmental effects are subject to mitigation by ongoing
public regulatory authority indicates that this proposed project does not have the potential
for significant environmental effects.
5. The extent to which environmental effects can be anticipated and controlled as a
result of other environmental studies undertaken by public agencies and the project
proposer has been considered and it indicates that this proposed project does not have
the potential for significant environmental effects.

The motion for the adoption of the foregoing resolution was seconded by Member Russell
and upon a vote being taken thereon, the following voted in favor thereof: Anderson,
Johnson, and Russell; and the following voted against the same: LeSuer and Micks,
whereupon said resolution was declared duly passed and adopted, signed by the Mayor
and her signature attested by the City Clerk.
