99-009 - 02-02 - Vacation of Drainage, Utility and Highway Right-of-Way Easements in the Schaper Area Resolution 99-9 February 2, 1999
Member Micks introduced the following resolution and moved its adoption:
RESOLUTION FOR VACATION OF DRAINAGE, UTILITY AND
HIGHWAY RIGHT-OF-WAY EASEMENTS IN THE SCHAPER AREA
WHEREAS, the City Council has met at the time and place specified in a notice duly
published with respect to the subject matter hereof and has heard all interested persons,
and it appearing that in the interest of the public that the following public easement be
vacated;
WHEREAS, a perpetual easement for drainage, utility and highway right-of-way
purposes over, under and across said location;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden
Valley that said easements lying within the corporate limits of said city as described below,
as the same as now laid out within the same limits of the said city, be, and the same now is
hereby vacated:
The South 193.00 feet of the West 267.00 feet of the East 754.29 feet of the
Southeast quarter of the Northwest quarter of Section 19, Township 29, Range 24,
except T.H. 55 right-of-way.
Also,
The South 650.00 feet of the West 120.00 feet of the East 874.29 feet of the
Southeast quarter of the Northwest quarter of Section 19, Township 29, Range 24,
except T.H. 55 right-of-way.
Said perpetual easement being all that part of the above-described parcel which lies
within the following described area:
Beginning at the Southwesterly corner of the above described parcel; thence
Northerly 44.38 feet along the Westerly line of the above described parcel; thence
Southeasterly 51.27 feet more or less to a point on the Southerly line of the above
described parcel which lies 25.27 feet Easterly of the Southwesterly corner thereof
as measured along said Southerly line; thence Westerly 25.27 feet along said
Southerly line to the point of beginning.
Together with a further perpetual easement for drainage, utility and highway right-of-
way purposes over, under and across all that part of the above described parcel
which lies within the following described area:
The South 70.00 feet of the North 194.80 feet of the above described parcel.
The above easements were created in Deed Doc. No. 2601285, Files of the
Hennepin County Register of Titles.

Also, a perpetual Drainage easement over, under and across all of Outlot A,
Schaper Natural Area as platted and recorded in the Hennepin County Register of
Titles.

The motion for the adoption of the foregoing resolution was seconded by Member LeSuer
and upon a vote being taken thereon, the following voted in favor thereof: Anderson,
Bakken, Johnson, LeSuer, and Micks; and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted, signed by the Mayor
and her signature attested by the City Clerk.
