01-72 - 12-03 - Authorize Agreement PW 61-13-01 Th 100 Segment V Project Resolution 01-72 December 3, 2001 Member Micks introduced the following resolution and moved its adoption, as amended: RESOLUTION AUTHORIZING AGREEMENT NO. PW 61-13-01 BETWEEN THE CITY OF GOLDEN VALLEY AND HENNEPIN COUNTY RELEVENT TO OWNERSHIP AND MAINTENANCE OF TRAILS, SIDEWALKS AND LANDSCAPING WITHIN THE RIGHT OF WAY FOR DULUTH STREET (CSAH 66) AND RELATED TO THE TH 100, SEGMENT V PROJECT BE IT RESOLVED by the City Council of the City of Golden Valley, Minnesota, as follows: WHEREAS, the Minnesota Department of Transportation (MnDOT) and the City of Golden Valley (City) and Hennepin County (County) have been negotiating to bring about the improvement of that portion of TH 100 in the vicinity of Duluth Street (CSAH 66); and, WHEREAS, the City and the County have developed an agreement relevant to the ownership and maintenance of trails, sidewalks and landscaping within the right of way for Duluth Street (CSAH 66) and related to the improvement of TH 100, Segment V; and, WHEREAS, it is contemplated that the construction and maintenance of improvements will be carried out in accordance with the provisions of Minnesota Statutes 1992, Section 162.17 and Section 471.59. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Golden Valley that: 1. The Agreement is approved. 2. The Mayor and City Manager are authorized and directed to sign the Agreement. 3. City staff is authorized and directed to take such actions as are reasonable and necessary to implement the Agreement. /OKua F Mary E. nderson, Mayor ATTEST: Donald G. riylor, City Resolution 01-72 - Continued December 3, 2001 The motion for the adoption of the foregoing resolution was seconded by Member LeSuer and upon a vote being taken thereon, the following voted in favor thereof: Anderson, Johnson, LeSuer and Micks; and the following was absent: Bakken, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk.
