01-85 - 12-18 - Connect to Sanitary Sewer by 3200 Block of Lilac Drive N Resolution 01-85 December 18, 2001 Member LeSuer introduced the following resolution and moved its adoption: RESOLUTION REQUIRING CONNECTION TO THE CITY SANITARY SEWER SYSTEM BY CERTAIN PROPERTIES ON THE 3200 BLOCK OF LILAC DRIVE NORTH BE IT RESOLVED by the City Council of the City of Golden Valley, Minnesota, as follows: WHEREAS, it is desirable to eliminate individual sewage treatment systems in Golden Valley in order to protect groundwater resources. WHEREAS, the City of Golden Valley has identified four homes, located at 3218, 3230, 3240 and 3250 Lilac Drive North, with individual sewage treatment systems. WHEREAS, municipal sanitary sewer, including service stubs, is now available to these properties as a result of the construction of Trunk Highway 100. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Golden Valley that connection to the municipal sanitary sewer system at the subject properties shall be required under either of the following conditions: 1. The City of Golden Valley receives notification by the Hennepin County Department of Environmental Services, the Minnesota Pollution Control Agency or any other agency with regulatory jurisdiction that the individual sewage treatment system at the subject properties has, or is, failing. 2. The homeowners undertake any improvements or additions to the property that would require upgrading or expansion of the individual sewage treatment system. BE IT FURTHER RESOLVED that: 1. The property owner shall make the required connection to the municipal sanitary sewer system within six (6) months of receipt of written notification by the City of Golden Valley of one of the above conditions. 2. The property owner shall be responsible for paying all permit and connection fees required by the City of Golden Valley at the time of connection. 3. The property owner shall pay a Sanitary Sewer Construction Charge in the amount of $4,000.00, in lieu of a special assessment for the benefit received from the construction of the sanitary sewer, plus the Sewer Access Charge (SAC) in effect at the time of permit application.
