02-33 - 04-01 - Amend Construction Agreement Glenwood Ave Resolution 02-33 April 1, 2002
Member LeSuer introduced the following resolution and moved its adoption:
RESOLUTION AUTHORIZING AMENDMENT NO. 1 TO CONSTRUCTION
COOPERATIVE AGREEMENT NO. PW 28-13-00 WITH HENNEPIN COUNTY
FOR PARTICIPATION IN THE CONSTRUCTION AND MAINTENANCE OF
GLENWOOD AVENUE BITUMINOUS PATH (XENIA AVENUE TO MEANDER ROAD)
BE IT RESOLVED by the City Council of the City of Golden Valley, Minnesota, as
follows:
WHEREAS, the County and the City executed Agreement No. PW 28-13-00 which
provides for the construction and maintenance of a bituminous trail on the north side of
Glenwood Avenue (CSAH 40) between Xenia Avenue and Meander Road; and
WHEREAS, during the final design it was determined that it would be desirable to
construct a wood and steel bridge to span an area adjacent to a pond as opposed to
extensive excavation of soils and installation of sheet piles; and
WHEREAS, the County has concurred with the construction of the bridge, and
WHEREAS, the original agreement did not set forth maintenance requirements for
the bridge; and
WHEREAS, the City and County have discussed the ownership, liability and long-
term maintenance issues and the City desires to take responsibility for those items as is
consistent with other city-owned pedestrian improvements located within County right-of-
way.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Golden
Valley that:
1. That the above recitals are incorporated by reference.
2. That Amendment No. 1 to the Agreement is approved.
3. That the Mayor and City Manager are authorized and directed to sign the
Amendment.
4. That City staff is authorized and directed to take such actions as are
reasonable and necessary to implement the Amendment.

The motion for the adoption of the foregoing resolution was seconded by Member Johnson
and upon a vote being taken thereon, the following voted in favor thereof: Grayson,
Johnson, LeSuer, Loomis and Tremere; and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted, signed by the Mayor
and her signature attested by the City Clerk.
