02-49 - 06-17 - Funds for Temporary Repairs to Sanitary Sewer System Resolution 02-49 June 17, 2002 Member LeSuer introduced the following resolution and moved its adoption: RESOLUTION RATIFYING THE EXPENDITURE OF FUNDS TO MAKE AN EMERGENCY TEMPORARY REPAIR TO THE SANITARY SEWER SYSTEM, AND AUTHORIZING STAFF TO SOLICIT QUOTES AND ENTER INTO AN EMERGENCY CONTRACT FOR A PERMANENT REPAIR TO THE SANITARY SEWER SYSTEM WHEREAS, on Friday, June 7, 2002, Public Works staff became aware of the compromised condition and capacity of a City-owned 24-inch sanitary sewer located beneath the Breck School football field and adjacent to the track; and WHEREAS, upon learning the condition of the sewer, Public Works staff took immediate action to develop a plan to bypass the sanitary sewer in the event that a risk to property damage or public health was possible; and WHEREAS, maintaining the flow at full capacity of the sewer is critical because it provides sewer service to an area in Golden Valley that is generally located south of TH 55 and east of Winnetka Avenue North, and conveys it to the Metropolitan Council's interceptor sewer system; and WHEREAS, on Monday, June 10, 2002, it was determined that the expertise and equipment of a large-scale contractor was needed to restore full flow and capacity to the sewer as quickly as possible; and WHEREAS, staff retained the services of GL Contracting to mobilize and make a temporary repair to the pipe at an approximate cost of between $10,000-$12,000 on June 10, 2002; and WHEREAS, when the temporary repair was made, Public Works staff conducted further investigation of the pipe and determined that it is critical that a permanent repair be made as soon as possible for the following reasons: 1. If the temporary repair were to fail, a backup could be caused resulting in damage to property and presenting a health and safety risk to the public. 2. Breck School staff has alerted the City that repair of the field and the track is needed for school functions in mid-July. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden Valley: 1. That the actions taken by staff and funds expended to temporarily repair the pipe are hereby ratified. Resolution 02-49 - Continued June 17, 2002 2. That the City Council hereby declares the repair of the pipe to be an emergency for the following reasons: a. The importance of the pipe to the City's sanitary sewer system; b. The need to repair the pipe in order eliminate the risk of backup of sewage into properties and homes; c. The need to eliminate the risk to the health, safety and welfare of citizens which is threatened by the condition of the pipe; d. The need to allow for the restoration of the Breck School facilities so as to reduce the impact on school operations expected to start up in mid-July. 3. That the City Council waives the competitive bidding requirements set forth in Minnesota Statues 471.345, and directs staff to obtain quotes for the necessary work from contractors who have demonstrated to staff their expertise and ability to provide the personnel and equipment necessary to immediately make the repair. 4. That staff is authorized to proceed with the work required based on the responsiveness of the contractor providing the quote. Gloria L. John n, Mayor Pro Tem ATTEST: Donald G.
