03-09 - 02-18 - Authorize Acquisition of 710 Boone Ave Resolution 03-09 February 18, 2003 Member Tremere introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING THE ACQUISITION BY PURCHASE OR CONDEMNATION OF CERTAIN REAL PROPERTY LOCATED AT 710 BOONE AVENUE NORTH FOR PUBLIC IMPROVEMENTS WHEREAS, the City's Capital Improvement Program has been duly reviewed and approved by the Planning Commission and the Golden Valley City Council; and, WHERAS, said Capital Improvement Program identifies the need to acquire a property located at 710 Boone Avenue North for the purpose of constructing a water quality pond associated with the Valley Square Redevelopment Project and the TH 55 /Boone Avenue North/General Mills Boulevard Project; and, WHEREAS, it is necessary, desirable and in the public interest to acquire the real property located at 710 Boone Avenue North and set out in Exhibit A attached hereto. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Golden Valley that: 1. It is necessary, desirable and in the public interest to acquire the real property described in Exhibit A, attached hereto, for public improvements associated with the Valley Square Redevelopment project and the TH 55/General Mills Boulevard/Boone Avenue North project. 2. Staff is authorized to obtain an appraisal for the property. 3. The City staff and City Attorney, or such other persons as necessary, are hereby authorized and directed to take all necessary steps and execute all necessary documents to acquire such real property. 4. In the event the real property described in Exhibit A cannot be expeditiously acquired by negotiated purchase, the City staff and City Attorney for the City of Golden Valley are authorized to commence condemnation proceedings, including "quick take" procedures under Minnesota Statutes Section 117.042, to acquire such property. 5. The acquisition of such real property is necessary and desirable and constitutes a proper and necessary public purpose. Linda R.
